Federal prosecutors have declined to charge former FBI Deputy Director Andrew McCabe, closing an investigation into whether he lied to federal officials about his involvement in a news media disclosure, McCabe’s legal team said Friday.
The decision resolves a criminal investigation that spanned more than a year and began with a referral from the Justice Department’s inspector general, which said McCabe repeatedly lied about having authorized a subordinate to share information with a newspaper reporter for a 2016 article about an FBI investigation into the Clinton Foundation.
McCabe’s lawyers said in a statement they were told in a phone call and letter that the case is closed and “no charges will be brought against him based on the facts.”
McCabe, a frequent target of attacks from President Donald Trump, has denied that he intentionally misled anyone. He has said his 2018 firing — for what the Justice Department called “lack of candor” — was politically motivated. He sued the Justice Department in August, saying officials had used the inspector general’s conclusions as a pretext to rid the FBI of leaders Trump perceived as biased against him.
In a letter on Friday, prosecutors told McCabe’s lawyers that they decided “not to pursue criminal charges against your client” after careful consideration.
“Based on the totality of the circumstances and all of the information known to the government at this time, we consider the matter closed,” said the letter, signed by the chief of the U.S. attorney’s office’s public corruption unit.
The decision was revealed at the week of startling tensions between Trump and the Justice Department over the treatment of one of the Republican president’s longtime allies and confidants, Roger Stone.

There was no jury in this, correct — it was just an internal investigation? So if Durham wants to indict (I think he has the power ...?) that can happen, and double jeopardy wouldn’t be an issue?
(Of course, I’m not holding my breath that Durham will end up doing the right thing.)

Andrew McCabe is an America-hating, commie pig. If the DOJ can’t understand that, they need to be fired too. The American people are now on their own. It’s Obama’s government workers against us. Stand for the Second Amendment. We’re going to need it before this is over.
Or, it is a maneuver to create credible indepence from the President, so that he avoids the “he’s a Trump lapdog” accusation when he drops bombs on big fish.
I doubt it, as plain facts say these are the actions of a swamper.

Now McCabe can brag that he’s been “exonerated”, and rub his critics’ noses in it. CNN is gloating, too.

Perhaps, depending upon your perspective.
My perspective is that this isolated case against is really more evidence against Mcabe in a larger prosecution than a stand alone prosecutable offense.
Pretty much every criminal lies about their involvement in their crimes.
Thats why we have trials in the first place.
Have not seen too many murderers, Mafia Dons or Drug Kingpins getting prosecuted for lying to investigators

Again, most likely we will be very disappointing. Durham is off investigating Russian collusion. Even if he was sincere and had anything, do you think the DOJ would let it see light.
So this is for his lies regarding the Clinton Foundation leak.
McCabe is still being investigated by Durham for Crossfire Hurricane.
