Judge Andrew Napolitano: Trump's Senate impeachment trial -- What does it take to remove a president?

The abuse consists of his efforts to extract a personal political "favor" from the president of Ukraine as a precondition to the delivery of $391 million in military aid. The favor he wanted was an announcement of a Ukrainian investigation of former Vice President Joseph R. Biden and his son Hunter.

The Government Accountability Office -- a nonpartisan entity in the federal government that monitors how the feds spend tax revenue -- has concluded that Trump's request for a favor was a violation of law because only Congress can impose conditions on government expenditures. So, when the president did that, he usurped Congress' role and acted unlawfully.

Federal election laws proscribe as criminal the mere solicitation of help for a political campaign from a foreign national or government. There is no dispute that Trump did this. In fact, the case for this is stronger now than it was when the House impeached him last year. Since then, more evidence, which Trump tried to suppress, has come to light.

That evidence consists of administration officials' emails that were obtained by the media pursuant to the Freedom of Information Act. Those emails demonstrate conclusively that Trump ordered a halt on the release of the $391 million within minutes of his favor request, and the aid sat undistributed until congressional pressure became too much for Trump to bear.

When the House Select Committee on Intelligence sought the emails unearthed by the press and then sought testimony from their authors, Trump thumbed his nose at the House. Instead of complying with House subpoenas or challenging them in court, Trump's folks threw them in a drawer. Earlier this week, his lawyers argued that those actions were lawful

I actually read a couple of Napolitano’s books. That was before he became a tiresome little man, with a chip on his shoulder.

Instead of taking the books to swap at a used book store, I tossed them in the trash.

Don’t know what happened to Napolitano. He’s pretty pathetic now.

What about Obama in 2012 telling the Russian President that he would have more "flexibility" after the election, to ensure that Putin didn't do anything that would hurt his chances for re-election.

The whole farce is based on Schiff and Ciaramella's interpretation of Trump motive in a very brief portion of the conversation with Zelensky.

Trump had legitimate reasons to delay aid--to try to get the Germans to pitch in and help more, to try to ensure a genuine battle against corruption in Ukraine (a country notorious for corruption). That he also thought he could get some political advantage against Biden is just Schiff & Ciaramella's inference...he asked Zelensky to "do us a favor," not "do me a favor."

That Biden was being bribed big time by the Ukrainians while being Obama's point man for Ukraine doesn't bother the Democrats in the least. We are living in an Alice in Wonderland world.

What's this hack talking about? There's a transcript of the call, literally none of this is in it. Oh, some fired bureaucrats were found who assumed that this was all happening in some smoke filled room that they weren't in? Huh. Okay, sure. Run with that like it's fact then, I guess.

The "judge" does not comment on a president's duty to safeguard taxpayers' money and/or to root out corruption by American citizens using connections to powerful US politicians in an effort to enrich themselves in foreign countries. The "judge" has also failed to take into account the comments of a confused and politically naive EU ambassador:

"No one else on this planet told you that Donald Trump was tying aid to these investigations, is that correct?” – Rep. Turner “Yes.” – Sondland."

Someone posted the legal requirement that foreign aid be tied to corruption by the recipients. I think it was the US Code. Anyone know?

I suspect some of the founders knew impeachment might become a political tool. Many did not want impeachment added to the Constitution, which is why it is hard to do (2/3rds of the Senate). There probably should have been explicit language about what would prompt an impeachment, like committing a federal crime.

Instead, the process of trying to take down ty he POTUS has involved non-elected officials going to prison primarily because of their association to Trump. Oh sure, some may have committed a crime, but in most cases, prison time would not have been the outcome.
