Op-Ed: New York’s bail reform disaster is about to become a major election issue
CNBC Politics ^ | Fri, Jan 17 2020 12:04 PM EST | Jake Novak

A story that’s beginning to boil over in New York is about to become a major issue in the 2020 election. That is, unless the Democrats can snatch victory from the jaws of defeat.

That issue is the controversial bail reform law pushed through the New York State legislature by Governor Andrew Cuomo late last year. The law eliminates cash bail on the argument that cash bail discriminates against poorer defendants.

But critics of the law have been warning for months that eliminating bail was sure to put too many criminals with violent tendencies back on streets, even if they weren’t currently under arrest for very violent crimes.

Less than three weeks after the law went into effect, it sure looks like the naysayers were right. […]

If all of this sounds like something tailor-made for President Trump to take advantage of, you’re right. […] Remember that Trump has already made a wedge issue out of sanctuary city policies and crimes committed by illegal immigrants. His decision to pinpoint those issues as a candidate helped him win over Republican voters in the 2016 primaries. But Trump could find even more bipartisan support by highlighting these no bail-related crime stories, which are already affecting Democratic elected leaders and their voters.

That’s even true for New York’s Democrat Governor Andrew Cuomo, who was most responsible for the bail reform bill passing last year. He stated earlier this week that he thinks some changes should be made to the law. But he didn’t say how or when. …

The same thing is happening in Chicago / Cook County. The cops arrest criminals -- excuse me, alleged criminals -- and all too often those same thugs are released almost immediately without bail. The horror stories of serious career criminals being set free, only to commit further crimes are adding up. Also, the Cook County State's Attorney has decreed that many crimes simply won't be prosecuted. In particular, shoplifters won't be charged unless they steal something like $1,000+ worth of merchandise. As a result, shoplifting is thru the roof. One local paper described it as a "tsunami of retail crime."

We’re just a Trump tweet away from New York’s bail problem from becoming something the entire party and its remaining presidential candidates will have to bear.

I'm sure nothing of the sort has occurred to Mr. Trump, being unfamiliar with New York as he is... (Chortling) this ought to be good.

It sounds like it must be the poor who are committing the crimes then.

It’s a NYC/Chi/SF race to the crime nadir.
They will all win(lose).

Soros basically now controls our justice system. We cried about it and nothing was done.

Same thing here in California with Prop. 47. Shoplifting and property crimes downgraded to misdemeanors and thus skyrocketing. Store personnel aren't attempting to stop it and cops not arresting anyone.

We are watching civilization breaking down before our eyes as law and order is systematically being eliminated.

My relative is a State Trooper. He said they are basically avoiding arresting anybody because after a 3 inch thick pile of paperwork, they let them walk anyway. Multiple times. Its futile.

They have legalized criminality.

Nobody has died yet but my money is on a domestic case.

Warren DeBlasio is not prosecuting fair beaters either.

The first year of the policy, the Transit Authority lost something like 45 million dollars from it.

“shoplifters won’t be charged unless they steal something like $1,000”

Ick.

I think they have that same problem out in San Fran. The shoplifters will actually add up on their calculators the amount, walk out of the store, pass it on and then go back into a store to continue shoplifting. The storeowners are drowning in debt and cannot get any relief in sight.

I thought it was only in CA.

[[[We are watching civilization breaking down before our eyes as law and order is systematically being eliminated. ]]]

This one issue, law and order, can be used to great effect against Democrats nationwide.

Amazing. I knew it was bad, but I had no idea they were that methodical about their shoplifting.

The only thing the merchants can do is lock everything up. It’s so depressing to go into a local store and see everything displayed with electronic buzzers attached or locked to the shelves. Not to mention that the costs of security and “shrinkage” are killing stores.

Too funny. According to the author, the issue isn’t the dumbassness of the no bail law, it’s the fact that Trump could make it an issue.

Don’t you need two parties for a political issue? Whoever wrote this is very naive. At best it will mean Democrats in New York will win with 70 percent instead of 80percent.

This is all Andrew Cuomobster’s work. Does this clown still think he’s a viable presidential candidate for 2024 and beyond?

IIRC, there are guys that specialize in "protection" who are not policemen.

Not an East-coaster myself, so I wouldn't know how that works, but I've seen it in the movies...

If the courts won't help, the cops can't do it, who you gonna call?

This is all Andrew Cuomobster’s work. Does this clown still think he’s a viable presidential candidate for 2024 and beyond?

No, he has an ally in the NYS Speaker of the Assembly, Carl "Imbecile" Heastie. A big mouth black activist whose every action is to "stick it to the man". He is so incredibly racist and plain stupid that he has already caused more crimes, including deaths, to occur. He is the roadblock between getting rid of this horrifically stupid and dangerous law and other dummocrap legislators modifying it or getting rid of it all together. Cuomo is a big part of it, but Heastie said, in a recent interview,

"...Assembly Speaker Carl Heastie says he has no intention of modifying New York’s controversial criminal justice system overhaul, which has enraged prosecutors, police and some judges by nixing most bail requirements and forcing early production of evidence in cases.

“I think I’m ready to let the law continue the way it is,” the powerful Bronx Democrat told reporters at the state Capitol Thursday. “We want safe communities but it is important to have a criminal justice system that treats everybody equally.”

He added: “I didn’t hear anybody screaming, and yelling or panicking, when Harvey Weinstein was able to put in a million dollars on bail, walk out of jail with all of the horrible things he did to people. So, we have to get out of this idea that bail equates to safety.”

But the pressure on Heastie continued to grow Thursday as even his fellow Democratic members of the Assembly told The Post it was becoming impossible to do nothing.

“I know we don’t want to change it, but I don’t see how we can ignore it, and not make any changes,” one legislator said.

So all on account of one racist black activist (notice that his bail example was Jewish), ALL of NY is held hostage by the maniac state assembly and mafioso governor. Many crimes have now occurred against citizens by criminals simply being set free and IMMEDIATELY doing the same thing again. A bank robber committed his 6th robbery as soon as he was released without bail. An illegal driving drunk killed someone. A black woman punched 3 Orthodox Jewish women simply walking down the street; released immediately without bail, she did the same thing the next day. The frustrated NYPD and NYC prosecutors have had to refer some crimes to the feds in order to get the perps locked up.

So glad I got outta that hell hole.
