LAS CRUCES Gov. Michelle Lujan Grisham is calling on state lawmakers to pass a red flag law during this legislative session, saying it would save lives in New Mexico.
This is a temporary removal of a firearm from an individual who poses an extreme risk or threat to themselves or others, the governor told a news conference in Las Cruces at the Doña Ana County Sheriffs Office.
She was flanked by Doña Ana County Sheriff Kim Stewart, Rep. Daymon Ely, D-Corrales, and Sen. Joseph Cervantes, D-Las Cruces.
Under the proposed legislation, a law enforcement officer or family member could request an extreme-risk protection order but would have to provide a sworn affidavit explaining in detail why the order is needed.
A judge would review the petition and determine if probable cause exists to issue a 15-day emergency order to seize weapons and ammunition. During those 15 days, the judge would schedule a hearing to decide if there is cause for a one-year order.
When the order expires, the guns and ammunition would be returned.
Lujan Grisham said this bill assures due process for gun owners.
Tony Mace, chairman of the New Mexico Sheriffs Association, said, Currently, the way that Senate bill and legislation reads, we will oppose it.
At the end of the day, if you have not committed a crime, you cannot be denied your constitutional right to bear arms. Thats what it boils down to, Mace said.

Yeah, right. With most judges in NM being Dem judges, some would just as soon confiscate guns completely without real probable cause. And once they get your guns, the chance that you are to legally get them back is probably nil and you have a black mark against you with the Feds if you try to buy a replacement.
According to Mace, during last year's 60-day legislative session, 29 of 33 members of the New Mexico Sheriffs Association opposed the red flag bill.

This is BS and everyone knows it- as soon as people fall for the BS and pass it- THEN the left will repeal any ‘due process protections’, and all it will take it an accusation for someone to lose their right to own guns, and will make law abiding citizens into felons just on the word of some disgruntled friend or family member

They passed crap legislation last year too. In New Mexico as of July 1 last year if you purchase a gun from a private person without a federal background check, you have committed a crime.

We are going to end up with one of those in Virginia, and like most of them it will be defined poorly, and left up to liberal prosecutors.
And while our governor insists that nobody will come to your house to take your gun, I have no idea how you would possibly enforce a “red flag law” without sending law enforcement to someone’s house to take their gun.

That’s what they did in Colorado. This year they’re going to go ham on us. No one at the Federal level is on our side no matter how unconstitutional the state law. My town cat lady council voted in sanctuary and all we get from the Feds is crickets.
