RICHMOND, Va. — Supporters of the Equal Rights Amendment are so confident Virginia is on the verge of becoming the critical 38th state to ratify the gender equality measure, they are already making plans for how they will celebrate.

But that jubilation could be largely symbolic. Despite broad support for the amendment in the state, the ERA’s prospects nationally are substantially more complicated.

The proposed 28th amendment to the U.S. Constitution faces a host of likely legal challenges and vehement opposition from conservative activists who depict the ERA as a threat to their stances on abortion and transgender rights.

Purely symbolic. The amendment expired in the 80s. It would be need to be passed by Congress again.

Then what? Businesses move out of VA. Equal rights are already on the books. But special equal rights, where the protected special ones are more equal than others? Untenable can of worms. Move ‘em out!

I remember the ERA being adamantly opposed on the grounds that it would authorize women to use the men’s restroom.

Now look where we are. Those oppositions seem so quaint.

This may go to the SC. The moment they pass this they are going to try use the previous state votes. If this amendment becomes law the country is finished or there will be a civil war, probably both.

Correct. A federal district court ruled that the ERA expired in June 1979 and that Congress' attempt to extend the ratification window to 1982 was done incorrectly. Appeals to higher courts failed. It's dead.

The only way to revive the ERA is to start the process all over again and submit it to the states for ratification by a two thirds vote of both the House and Senate. The votes aren't there.

Virginia's Letter of Ratification will be returned to Virginia's Secretary of State by the Archivist of the United States with a letter explaining that the state's ratification was 40 years too late.

There’s also the issue that, during the original 7 year ratification period, a few states rescinded their ratifications of the ERA. Their plan to make Virginia the key 38th state to ratify, assumes that those states were not allowed to rescind their ratifications.

Congress wrote an expiration date into the amendment.

If Democrats hadn’t been so stupid, it might have been ratified today.

Not even a Clinton or an Obama judge can help them with it.

A state has the right to change its mind. They’re still short of 38.

Congress would need to restart the process and the votes to pass it again in Congress aren’t there.

ILLINOIS passed ERA two years ago. It was a symbolic vote.
