McConnell Suggests Senate Will Move to Dismiss Impeachment After Opening Arguments

Senate Majority Leader Mitch McConnell (R-KY) hinted in a speech on the Senate floor Tuesday morning that the Senate will move to dismiss the pending articles of impeachment against President Donald Trump after opening arguments in the expected trial.

McConnell was reacting to a proposal by Senate Minority Leader Chuck Schumer (D-NY) on Monday that the Senate call four additional, in-person witnesses that were not called, or not available, during the House inquiry, led by House Intelligence Committee Chairman Adam Schiff (D-CA). But McConnell dismissed that suggestion out of hand, arguing that Schumer was trying to make “Chairman Schiff’s sloppy work more persuasive.” McConnell accused Schumer of going straight to the news media with his proposals rather than speaking to him in person, as Senate leaders had done in the past.

He also noted that Schumer had misquoted the Constitution. The Democrat leader had claimed the Constitution gave the Senate “sole Power of Impeachment,” whereas Article I, Section 3 actually states, “The Senate shall have the sole Power to try all Impeachments.” “We don’t create impeachments over here … we judge them,” he declared. It was the House’s role to investigate, and to build a case. “If they fail, they fail! It’s not the Senate’s job to leap into the breach to search desperately for ways to get to guilty. That would hardly be impartial justice.” The Senate would not, he said, participate in “new fact-finding” that House Democrats were “too impatient” to pursue.

The Republican leader said he agreed with Schumer’s suggestion that the Senate follow the model used in President Bill Clinton’s impeachment trial in 1999, but accused Schumer of departing from that precedent.

In the 1999 trial, McConnell noted, here there were two procedural motions — one at the start of the trial, which allowed for a motion to dismiss; and a later one guiding the trial’s procedures and conclusion.

This is the correct thing to do.

As much as President Trump would love a long trial in order to destroy lying and false witnesses, it would serve him and the country better for an immediate vote to acquit,

Which would send a one finger message back to Schiff for Brains and the other House Rats.

makes sense to me...the 2nd article of impeachment is only there because shitt did not want to go to court re: exec branch ignoring subpoenas from the legislature branch. that was a big mistake in shitts' obsession with trump.

Nope....No sense in a trial. Move to dismiss. Get that out of the way. Then you can introduce anything you want.

But in reality...get on with business. That's your job....not endless attempts to take down the President of the United States.

How do we reconcile the Constitution saying that the Chief Justice presides over the Senate trial and Mitch thinking he as Majority leader will be able to call the shots? Then we also have the Vice President who is President of the Senate.

Who is in charge?

Could the CJ hijack the trial and rule that he will allow Schumer and the House Managers (probably Schiff being one) to call whatever witnesses they want?

This is what I agree with. McConnell should speak about how the Democrats failed to make a case, and how they lied, then dismiss the whole damn thing. Get it over with, while blasting the Dems for their obsession and lies.

Hopefully later in 2020, there will be convictions on Dems that will lead to jail time.

Let Trump use all of it during the campaign.

Dems will scream Bias, unfair ...blah blah blah...this won’t change anyone’s mind on the right or left. Independents are likely fed up with this nonsense.

Quick dismissal because there are NO impeachable charges. I first thought it would be better to let the president have his trial, but I changed my mind for two reasons. First, the media will ONLY report what they want, and it won’t be anything favoring the president. Second, you just don’t know what those snaky, evil dems will pull. Good people don’t think like the dems.

The witnesses the president wants to hear from will be heard when Durham/Barr do their thing.....same players.

Agreed, though I still have a part of me that wants to drag Hunter, the ‘whistle blower’, and Schiff around in leg irons and make them testify under oath about how this all started.

I think a trial with real evidence would consume the dems for awhile. Too many process crimes which now have been shown to be falsified fbi notes.

In an impeachment trial, I believe the Chief Justice basically serves as a “judicial consultant” of sorts, overseeing the formalities of the trial and ruling only on matters of constitutional law.

A motion to dismiss is the only way to go. An endless process of a trial will serve the communist Democrats to play games at our expense. Send the damn thing back to the communist controlled House and let them have a show.
