McConnell rips Schumer impeachment demands, vows not to pursue ‘fishing expedition’

Senate Majority Leader Mitch McConnell struck back Tuesday at his Democratic counterpart's calls for an in-depth impeachment trial featuring multiple new witnesses, dismissing the push as a "fishing expedition" that would set a "nightmarish precedent."

"The Senate is meant to act as judge and jury, to hear a trial, not to re-run the entire fact-finding investigation because angry partisans rushed sloppily through it,” he said on the Senate floor.

In a Sunday letter, Senate Democratic Leader Chuck Schumer had called for the chamber to subpoena new documents and call witnesses who had been blocked by the White House during the impeachment inquiry on the House side.

McConnell, R-Ky., claimed that such investigative steps, though, were part of the House role -- not a mission for the Senate. He warned that entertaining Schumer’s proposal to do House lawmakers’ “homework” could invite a string of future “dubious” and “frivolous” impeachment inquiries.

He stressed the fact-finding mission should have been completed during the impeachment inquiry led by House Intelligence Committee Chairman Rep. Adam Schiff, D-Calif. McConnell accused the House of doing a rush job, and said Schumer is now looking "to make Chairman Schiff's sloppy work more persuasive."

I agree. With the rules now in place a full blown trial with witnesses could turn into a marathon, we don’t need that.

McConnell is getting high marks in my book. Unlike some past republican majority leaders, he pushes back and is counter punching. Wonder if he learned this from the master counter-puncher, Donald J Trump.

I'm going to take the contrarian position.

They've been meeting - Turtle and Schuck - for over a month.

Schumer's kabuki gives Turtle the impetus to file for summary acquittal, rather than let Trump have any trial, a trial which Turtle signaled on Oct16 that he would let run for months and completely disrupt the Donkey Cart campaigners if he didn't get his way.

The Clinton trial has a good pattern. Each side was allowed to present its case (case and then defense), and was allowed a time certain for that. That process took a little more than a week.

There was a Q&A period for senators, not much of that used. Then the trial was paused while a committee or two went and got additional evidence, in private. Those results cam back when the trial was resumed, a couple weeks later.

At any rate, I'm with you. This should not take weeks. That said, both sides must be given a chance to present. This should not be a dismissal after only the House presents its case against.

The House GOP has argued why the conduct is not a high crime and misdemeanor. some of that will inevitably be repeated, but what has not been presented is evidence of why it was reasonable for Trump to have the suspicions he had.

Senate trial might be different, but the components of prosecution ought to relate to a normal trial:

1) Establish that a certain conduct has been defined as a crime under law.
2) Establish that such a crime has occurred on a specific occasion.
3) Accuse a Defendant of being the person who dun it.
4) Prove that Defendant did it beyond a reasonable doubt.

Charge One of Impeachment: Bribery. Is it “bribery” to ask the resident of a notoriously corrupt county to investigate/curtail corruption before handing his country US foreign aid? Obviously not. Was throwing in the Bidens of limits? No, the Bidens clearly need investigation. Charge One is without merit. Dismissed.

Charge Two: Obstruction of Congress. Refusing to comply with subpoenas issued without legal authority (full vote of the House) is not obstruction. The Senate has the authority to rule the subpoenas were requests with no validity. Charge Two is without merit. Dismissed.

Impeachment over. Time for an early lunch.
