U.S. prosecutors and defense attorneys for Michael T. Flynn asked a federal judge Tuesday to postpone Flynns long-delayed sentencing until after the Justice Departments internal watchdog issues a report in coming weeks on the handling of the FBIs investigation into possible coordination between Russia and the Trump campaign in 2016.
Sentencing for President Trumps former national security adviser is set for Dec. 18, and federal prosecutors were scheduled to notify the court Monday whether they would reverse their recommendation of probation and instead ask for prison time for the retired three-star Army general.
However, in a terse, two-page filing, both sides said Tuesday evening that they expect the forthcoming report by Inspector General Michael Horowitz, due Dec. 9, will examine several topics related to a Flynn defenses request to find prosecutors in contempt for alleged misconduct.

I’m afraid the report isn’t going to help Flynn. Horowitz applies a very technical legal analysis which gives the FBI the benefit of the doubt. Hope I’m wrong.

The evidence is not admissible in a court of law and the charges are thrown out.
If it's found that the Fisa warrant was illegally obtained, all charges against Flynn and others should be dropped also............Well, we can only hope.

Flynn said he lied to save his son’s backside, who, he was told, was going to be targeted for another generally ignored “crime” of lobbying for a foreign government without an official lobby certification. Here he says that he told the truth to the best of his ability. IOW, they construed a lie out of what he said, and his admission being necessary to the Mueller investigation’s reputation at the time, he agreed it was a lie in order to save his son. Noble, actually, on his part.
But, the government committed serious offenses in its investigation and sharing of materials with his defense. The only remedy, says his lawyer, is to throw out the entire case. That is the only remedy to kill his “deal” not to prosecute his son.
I wonder why Barr can’t just look at the case and drop it. These DOJ machinations totally puzzle me. Are the Flynn prosecutors NOT under the direction of Barr???

Notice WaPo's sly insertion of something that never happened and which Mueller's report admitted. The FBI wasn't investigating anything. They were spying and trying to manufacture evidence of a non-existent crime.
Since I have zero faith in our administrative deep state of which the IG is a part, I don't expect much from his way overdue report.
Like Trump cant micromanage every mid-level employee, Barr cant micromanage every case, and shouldn’t get caught up in that. Barr, like Trump, has to fix the “system” from the top down. That isn’t always so easy when so many cogs in the wheel are predisposed to be against you.
I don’t think Flynn’s legal team expects the report to help their client directly by documenting specific cases of wrongdoing on the part of the FBI. More likely, they believe it will contain references to exculpatory material that the prosecution hasn’t turned over to them under their required Brady filings.
I don’t think the Flynn case has anything to do with FISA warrants. He may have been subject to surveillance under a FISA warrant earlier in 2016, but his conversations with the Russian ambassador that were the basis of the FBI’s interrogation of him were not covered under a FISA warrant. As a foreign diplomat the Russian ambassador would have been under direct surveillance by U.S. intelligence agencies as a matter of course, and since he’s not a U.S. citizen he doesn’t have any legal protection under U.S. law that would have required anyone to obtain a FISA warrant in the first place.

I think Sydney Powell is being fed information from someone in the DOJ.
Rush Limbaugh says the Horowitz report will be a nothingburger. Horowitz is a democrat. We have the evidence of his earlier report that whitewashed Comey’s crimes.
I’ve said for months now that Horowitz will be a few small fry sacrificed, but the big fish walking.
And, iirc, Durham is also a democrat. I know I’ve read that before. And, based in New Hampshire, I believe, the odds are pretty good that he’s a democrat.
Flynn is not an insignificant case. This was the President’s hand-picked National Security Advisor.
I don’t disagree, but as soon as Trump or Barr get ‘personally’ involved, it opens the door to more ‘obstruction of justice’ BS challenges. Better to correct the system, via putting good subordinates in place, than to get too hands on with any single case.
That was my impression as well. Flynn’s lawyer is a Brady Material expert.
