Trump defends Brett Kavanaugh after sexual misconduct allegations resurface

President Donald Trump leapt to the defense of Supreme Court Justice Brett Kavanaugh Sunday after allegations of sexual misconduct that had once threatened to torpedo his nomination to the bench resurfaced.

"He is an innocent man who has been treated HORRIBLY," Trump said on Twitter, referring to the accusations as "lies." The president also accused critics of attempting to influence Kavanaugh's opinions and suggested that Kavanaugh "start suing people for liable, or the Justice Department should come to his rescue." (Trump apparently meant "libel," and later re-issued the tweet with the correct spelling of the word.)

Kavanaugh was nominated by Trump after the retirement of Justice Anthony Kennedy, a swing vote on the court. He was sworn in last October after a confirmation process that focused on the allegations — and the protests, controversy and high drama of the Senate hearing that followed.

I do believe these Progressives are liable for committing libel and slander. . . I also believe the are lie able, since they are able to lie about anything that progresses the Progressive agenda.

we value our liberties, they want to take them away from us in imposing their idea of an idealistic Fourth Reich type of socialist dictatorship against us

and they will smear and smear and smear and smear any American they wish, they show zero moral principles or scruples (not even any human decency, you don’t have to be religious at all to know not to spread malicious lies against a person)

The independent unaccountable Justice Department? That Justice Department? If you can't do anything else, then just cut their personnel budget by about 30% as a start, and make clear cuts will keep happening until they straighten out, fly right and hold folks accountable for anti-constitutional behavior - or the department is eliminated. Their choice.

It’s a bad precedent for a Supreme Court justice to sue. It’s a lifetime position. If the Senate charges him, it’s okay to defend but he should not be suing accusers regardless of how blatant.

Kavanaugh is a public figure, as such, it is extremely difficult to prove libel or slander *with malice aforethought* which is the bar set for public figures. IOW, you not only prove that it was a lie, you have to prove the accusers knew it was a lie and that the accusers did so anyway with the intention of doing harm to the accused.

A SCOTUS justice, if anyone, already knows this and would be stupid to sue. If this gets to impeachment in the Senate then, by all means, produce a defense. However, suing to clear one’s name in this case is as stupid as making a murder defendant take the stand in their own defense. There’s a reason lawyers counsel their clients not to do it.

Isn’t the fact the charges are being made forty years later, with no corroboration, prima facie evidence of malice aforethought? Why else would they be doing it?

Balsey Ford’s lawyer let it slip the purpose for making her charge was to put an asterisk next to his name. In other words, to dirty his reputation.

No, it’s not proof. Proof would be a produced statement admissable in court that says “Let me fabricate a story so as to derail his nomination.”
