Supreme Court allows Pennsylvania transgender bathroom policy to go into effect

The Supreme Court on Tuesday declined to take up a challenge to a transgender bathroom policy for a Pennsylvania school district, allowing it to go into effect.

The court's unsigned order means that students in the Boyertown district will be allowed to use the bathroom or locker room aligned with their gender identity.

If Pennsylvania legal majority citizen voters do not want transgender bathrooms in their state then Pennsylvania state government is failing to provide its citizens with a republican form of government guaranteed by the Constitution imo.

"Article IV, Section 4: The United States shall guarantee to every State in this Union a Republican Form of Government [emphasis added], and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."

This means not even 4 judges agreed to accept case?I think they are waiting for the inevitable really bad outcomes to result from these policies, when deciding a case will be easier. Or, maybe the various states will rediscover that they are responsible for making their laws, not the SCOTUS.

I have heard a member of the “Boyertown Five” speaking before the banquet of the Pennsylvania Family Institute.

PFI has devoted many resources to defend the students to this level.

As disgusting as the new rule is, I don’t see how the federal government has any jurisdiction here. It’s clearly a state matter. Then SCOTUS should never have made it a federal matter by come up with a contrived sanction of homosexual marriage, and thus criminalizing dissent by states that refuse to recognize it.

Now that they have done so, then they should be obligated to deal with the resulting conflicts, rather than cowardly not doing so.
