Supreme Court won't stop Trump administration's bump stock ban originally appeared on abcnews.go.com
The Supreme Court will not stop the Trump administration's ban on bump stocks from going into effect, it was announced on Thursday.
The ban on bump stocks was announced by the Justice Department in December 2018 and took effect on Tuesday. On Monday, the Supreme Court was considering an emergency request from Gun Owners of America, Gun Owners Foundation and the Virginia Citizens Defense League to stay the ban while cases challenging it were appealed.

There is a vast difference berween a particular range banning their use at its own range and a regulatory agency arbitrarily making law rather than congress. You may have also noticed that no one at your range became an overnight felon if he did not destroy or turn in his personal property (without compensation) to the feral government.
You are correct in your assessments, although I will do just a bit of nitpicking. Open bolt semi autos were not declared to be machine guns by ATF. The production of new open bolt semi autos was banned because they were found to to readily convertible to full auto, which is in fact the case. However, existing guns were grandfathered, unlike the Constitutionally deficient bump fire stock ban, where possession became an instant felony, with no opportunity for grandfathering, and no compensation for the taking of citizens personal property.
So, the president completely quiets the other side with this EO, fully knowing that, eventually, it will get overturned by the SCOTUS if anyone bothers to fight it. And it is about something nobody on either side really supports, except the hard core principle of “anything that so much as touches a gun should not be banned” purists.
I understand the concept of slippery slope, but sometimes it’s necessary to spend a little time on the edge of that slope. Life is risk.
Agree. IMO Trump decided to do the very least thing he could do to derail further calls for gun control. I’m opposed to all gun control but in reality this is not a big deal.
I take all of my firearms very, very seriously. We have a large collection. I reload cartridges for every caliber that we own.
I have seen irresponsible idiots on several occasions using these toys to fantasize that they are shooting a machine gun. They are not only irritating; they put other people at risk because these yahoos typically do not have good control over where their projectiles are striking. Every time I have seen people using them at unregulated spots the morons were boozing it up at the same time. They give responsible gun owners a bad name. So Democrats absolutely love them.
When they were banned at our gun club there wasn’t any debate about it. These things are only of interest to reckless thrill seekers. So I am not going to lose any more sleep over them being banned than I would if someone invented some type of self driving car that kept running over pedestrians till it was banned.
I am shocked that we have so many proponents. I thought that the people here were mostly serious firearms users not armchair idiots, bloviating about complete nonsense.
I don’t think they can outlaw belt loops and thumbs which serve the same purpose as bump stocks. Still, I don’t understand why Trump ever went along with this.
“Serious gun enthusiasts think they are stupid.”
I’m serious into self defense. For self defense or hunting purposes, I just can’t see owning one. For out of home self defense, a concealed pistol. For inside the home either a pistol or shot gun.
But this ban does give the lefties an inch. As the saying goes, give an inch, take a mile.
You are missing the point. Are you comfortable with the fact that a regulatory agency has arbitrarily made a change in federal law, i.e. the definition of a machine gun? Machine guns are prcisely defined by law, and changes to that law MUST be made by congress. Another equally egregious issue here is the fact that owners of bump fire stocks are faced with the choice of either destroying or turning in their stocks to the feral government or become a felon. Notice that they will receive no compensation for having their personal property confiscated.
You may not be losing sleep over these issues because you dont like these stocks, but you sure as hell should be losing sleep over the fact that what we have here is a wholesale violation of the Constitution, and it is depressingly likely that the feral government will get away with it, as the courts have so far simply ignored the issues raised in the lawsuits.
As a side note I do not and have never owned a bumpfire stock, even though I own enough AR15s that I could not give you an exact count without consulting my inventory sheets or searching my safe(s). I have no personal animus against them, I simply have no place where they could be conveniently used, and other than using one on a .22 AR or possibly a 9mm, ammo is too expensive to waste.
We can’t win every single battle. And sometimes we “lose one” to win the war.
At this time the justices on the Supreme Court do not seem to feel that this issue is the “wholesale violation” of the constitution that you believe that it is. If President Trump gets a second term and is able to appoint a couple more actual conservatives to the court, maybe the majority would find this regulatory action “unconstitutional”. Currently, there is not much of a chance that they would.
All the exaggeration and hand wringing is not going to convince any of the current justices to change their mind. That is just not how it works. You can choose to live in some type of fantasy world and continue to believe that the current Supreme Court is going to hear someone’s lawsuit on this and reverse the action. I am just telling you that it is not likely until after Ginsburg drops over dead and Sotomayor goes into a diabetic coma and has permanent brain damage.
For all practical purposes, it’s only relevant either for sentencing or search warrants. The latter is what’s worrisome.
The president has no intention of seeing his order overturned. He supports this because he believes in it.
He also publicly castrated the nra with Feinstein in attendance.
Do not attempt to act like this isnt a big deal or that its not really Trumps doing.
Allowing the president to write brand new law out of thin air poses an existential threat to the republics institutional integrity. Thats not hyperbole or exaggeration. Its cold hard fact.
I hope trump didnt lose 2020 over this but its a very real possibility.
Obviously opinions vary.
The statement that the president has written / amended law outside of his authority is not an opinion.
Bump stocks slide down a slippery slope
The globalist tyrants really want to disarm the "Americans Behind Every Blade of Grass" factor and they will do it incrementally if they have to.
