9th Circuit sinks Kate Steinle parents' lawsuit against 'sanctuary city'

A federal appeals court ruled Monday the parents of Kate Steinle, who was shot and killed by an illegal immigrant in 2015, cannot sue San Francisco for the "sancutary city’s" failure to tell immigration officials about the shooter’s release.

Steinle’s parents alleged San Francisco and the city’s former sheriff shared the blamed for their daughter’s death because officials did not notify Immigration and Customs Enforcement when Jose Ines Garcia Zarate got out of jail.

If congress had conservative balls, it could actually dissolve the 9th and either redo it or just not replace it at all and absorb it into other existing courts.

I don’t know the merits of the case. I do know it is really difficult to successfully sue government officials.

I notice that one of the three Circuit judges handling this appeal is Judge Mark Bennett, the first Trump appointee to the 9th Circuit of Appeals. He was confirmed with 27 votes against him; all Republicans. I guess it’s hard to come up with a winner from Hawaii.

The article leaves out all the important details, like was this just a 3-judge panel or the entire en banc court?

If it was the 3-judge panel, then there is still the chance for an en banc review, now that President Trump has added his own judges to the court.
