Supreme Court rejects Trump plea (5-4 Roberts joins the liberals) to enforce asylum ban

he Supreme Court won’t let the Trump administration begin enforcing a ban on asylum for any immigrants who illegally cross the U.S.-Mexico border.

New Justice Brett Kavanaugh and three other conservative justices sided with the administration.

The court’s order Friday leaves in place lower court rulings that blocked President Donald Trump’s proclamation in November automatically denying asylum to people who enter the country from Mexico without going through official border crossings.

Trump said he was acting in response to caravans of migrants making their way to the border.

The administration had also complained that the nationwide order preventing the policy from taking effect was too broad.

But Chief Justice John Roberts and the court’s four more liberal justices rejected the administration’s suggestion for narrowing it.

Asylum denied.

Fine, but the law in question allows the immigrant to request asylum and enter into whatever process is used to adjudicate that request - even if it consists of Trump saying "you're deported!"

Trump's ban said they can't even request it - in direct contravention to the law.

No, that's Trump's policy, which the court put on hold. The statute makes clear it can be made anywhere in the United States.

That's why the ruling was correct. The Executive Branch can't change law. I know, Hussein did it. If Freepers recall, Arizona pass some immigration law, and was mostly shut down by the USSC because the States can't make law contrary to Congressional law. It's up to Congress to change immigration law, which they fail to do.

That said, Pres. Trump did an end run and got Mexico to keep so-called asylum seekers in their country. Brilliant! What president could have ever negotiated such a deal?

Seems like Roberts makes law for foreigners not Americans. Can’t Trump just ignore it?

Agree, your description is more accurate. However in this case, no arguments, no opinions, just a rejection of a government request to block a ruling by a Federal District Court that prevented the government from taking action on their asylum procedures. The government now must wait until the Circuit Court considers their appeal.

But the courts can? What are you people smoking? The POTUS has total authority over national security—border security. If he wants to deem these people invading foreign nationals(which is what they are), he can. He can SHOOT them rather than give them asylum. He can close down the borders. Stop all travel in and out. Stop all immigration.

Then again, he can declare martial law, too, and start weeding out these farking commies that have infested every aspect of ‘our’ gubbermint. Especially the courts

They’re unelected, black-robed tyrants who should be ignored. Considering the damage they’re doing to what’s left of our constitutional republic, they should be rounded up and sent to gitmo.

I may have missed a comment that correctly discusses what the Supreme Court did, but I think that we are all dolts, including my first comment. We don’t know we are talking about.

The Supreme Court did not rule on the merits. They denied a government request to overrule the District Judge prohibition on carrying out the new asylum rules. The Court told the government to wait until the Circuit Court considers the case.

We are going to have to wait until the 9th Circuit rules that Trump can’t do this (as they will certainly do), and then the DOJ will have to appeal to the Supreme Court and the Court will have to decide whether to hear the case or not.

Lesson learned for me. Real the article and then research the issue to ensure that I understand before I start talking. The place to go is scotusblog.com

With my extremely limited legal understanding, I don’t see the courts having any constitutionally authorized jurisdiction in this matter. In my humble opinion the President should go full Andrew Jackson on them and tell them to kiss off and continue doing it.

I clearly recall when the courts overruled Obama’s ban on drilling in the Gulf of Mexico and he ignored it for 6 months and nobody in the media gave a good down. And the courts didn’t do anything either, because they couldn’t.
