Trump backs off executive order threat, says Congress is better path to end birthright citizenship
The Washington Times ^ | Wednesday, October 31, 2018 | Stephen Dinan

President Trump said Wednesday he’s still committed to ending birthright citizenship for babies born to illegal immigrants, but would prefer to go through Congress rather than use an executive order.

That’s a softening of his stance from an interview published Tuesday, where he told Axios, an online political outlet, that he was preparing an executive order to test the boundaries of the Constitution’s definitions of automatic citizenship.

Mr. Trump, who during the 2016 campaign had called President Obama’s executive actions on immigration unconstitutional and illegal, also cited those as precedent for his own plans.

“If he can do DACA we can do this by executive order,” the president told reporters as he prepared to jet to Florida for a campaign rally.

Mr. Trump said curtailing birthright citizenship was “much less complex” than some were making it out to be.

“I’d rather do it through Congress because that’s permanent. But we can certainly do it through … executive order,” he said.

His suggestion of tackling birthright citizenship has drawn opposition from those both inside and outside the GOP, with House Speaker Paul D. Ryan shooting down the plans on Tuesday.

Let’s hope you’re wrong because an EO is definitely a stroke of genius. I have a suspicion he’s going to drop the EO anyway on the eve of the election.

He said he would rather congress do because that is permanent.

What's is there for Congress to do. The Constitution says what it says. It's up to Trump to order the executive branch not to make anchor babies, citizens.

The art of the walkback. My guess is his legal advice on his ability to do it was Stephen Miller.

He folded his cards without looking

What Mr. Trump showed was that he will be dealt a full house when the mid-term elections are over. He got MSM, speaker Ryan and a bunch of never-trumpers to show their cards.

He did not fold. And they know he does not bluff.

I’m wearing a Donald Trump costume for Halloween. This is the best costume in the world, believe me, nobody else has a costume like this, it’s huge. Other peoples costumes are a total disaster, made in China. China has created many many bad costumes that are a terrrible deal, believe me. My costume, which is the best in the world, was made by hand by people in Ohio, I love the people of Ohio, very talented, very smart people

There’s nothing to walk back unless he has changed sides.

Your confused, there is a difference between guilt by association, and a comparison. I merely pointed out the obvious similarities between you and the anti Trump msm. I never said you were blowing them.

He needs to use regs to stop the ANCHORING by STOPPING the issuance of SS#’s at birth (IRS) & passports from the USA(STATE DEPT). These are changes he can order then... LET THEM CHALLENGE IT!
This plan would essentially say is no citizenship will be given where it cannot legally be conferred and put the PROOF ON THEM RECEIVING IT!
Note that it has been admitted that IA’s were helping keep the SS funding afloat.

Amend U.S. Code 8, Section 1401 and the problem goes away.

On the matter of anchor babies, I believe U.S. Code 8, Section 1401 simply restates the wording in the Constitution. Perhaps you can point out to me what in that US Code needs to be changed.

Pointing out similarities is associating. Again, this is basic grade school stuff. Shouldn’t be too hard to grasp.

But now he has surrendered.

It seems quite risky to second-guess Trump in the middle of making a deal.

Most of us wish he would just write the EO tomorrow based on the opinion of his legal team.

Congress, of course, has been paralyzed for decades by what the deep state/RINO's have put in place and may attempt to run out the clock. An EO will get us to the courthouse very quickly. And, that where it is going even if and when Congress passes a law.

It seems likely Trump is intentionally putting some heat on specific members prior to Nov 6.

Again. Thats why we have waves of caravans, Syrian rapefugees, no border funding, no repeal of obamacare.. but we do have trillions of taxpayer dollars in continuing resolutions for Chuck n Nancy and the next eave stats every Christmas.
