Trump backs off executive order threat, says Congress is better path to end birthright citizenship

President Trump said Wednesday he’s still committed to ending birthright citizenship for babies born to illegal immigrants, but would prefer to go through Congress rather than use an executive order.

That’s a softening of his stance from an interview published Tuesday, where he told Axios, an online political outlet, that he was preparing an executive order to test the boundaries of the Constitution’s definitions of automatic citizenship.

Mr. Trump, who during the 2016 campaign had called President Obama’s executive actions on immigration unconstitutional and illegal, also cited those as precedent for his own plans.

“If he can do DACA we can do this by executive order,” the president told reporters as he prepared to jet to Florida for a campaign rally.

Mr. Trump said curtailing birthright citizenship was “much less complex” than some were making it out to be.

“I’d rather do it through Congress because that’s permanent. But we can certainly do it through … executive order,” he said.

His suggestion of tackling birthright citizenship has drawn opposition from those both inside and outside the GOP, with House Speaker Paul D. Ryan shooting down the plans on Tuesday.

Of course the duty shirkers in Congress should get this straightened out. It’s their job.

But it is unlikely that the ‘Critters will get up off their dead butts and do something.

agreed congress will do nothing. His educative order was clear short path to the USSC to resolve it and move on. But now he has surrendered. those who see some magical strategy everytime he rants are delusional.

i always thought Trump was trolling with that claim of using EO to eliminate anchor babies ... and it worked too: fake stream media and Dems went berserk trying to protect anchor babies, which was what Trump wanted to happen ... those fools never learn ...

I don't see it as backing off. He said he would rather congress do because that is permanent. But that he could also do it via executive order. But then I don't let the msm tell me what to think.

Since Democratic members of Congress probably see birthright citizenship as Democratic votes, Trump is undoubtedly calling for patriots to flex their might voting muscle and vote Republican ticket.

exec order immediately...
and then let congress screw around with it as much as they’d like

since the conferral of USA citizenship on ‘anchor babies’ is not authorized by law (at least nobody has cited any statute).....a future president will NOT be able to start conferring American citizenship on them by a new exec order)

All he has to do is order his staff to obey it.

You are correct

His EO could simply cancel any mandates that the State department and DHS may have to recognize citizenship in these cases, things that were done with out justification

Then it would be up to Congress to enact “clarifying” legislation.
