Trump backs off executive order threat, says Congress is better path to end birthright citizenship

President Trump said Wednesday he’s still committed to ending birthright citizenship for babies born to illegal immigrants, but would prefer to go through Congress rather than use an executive order.

That’s a softening of his stance from an interview published Tuesday, where he told Axios, an online political outlet, that he was preparing an executive order to test the boundaries of the Constitution’s definitions of automatic citizenship.

Mr. Trump, who during the 2016 campaign had called President Obama’s executive actions on immigration unconstitutional and illegal, also cited those as precedent for his own plans.

“If he can do DACA we can do this by executive order,” the president told reporters as he prepared to jet to Florida for a campaign rally.

Mr. Trump said curtailing birthright citizenship was “much less complex” than some were making it out to be.

“I’d rather do it through Congress because that’s permanent. But we can certainly do it through … executive order,” he said.

His suggestion of tackling birthright citizenship has drawn opposition from those both inside and outside the GOP, with House Speaker Paul D. Ryan shooting down the plans on Tuesday.

It worked, it made the propaganda parrots in the media do the big chicken.

All while at the same time gave Trump the opportunity to publicly get this out there that he wants to dump this country killing stupid BS. We need to end this policy of running across the border, dropping a baby and getting instant free prizes and citizenship status.

Interesting inference. However, being an independent thinker takes more than merely being consistently contrarian.

Or pretending to be consistently contrarian causes one to continuously whine over everything Trump does or says. You may not realize it, but you are obviously transparent.

It’s always cringey when Presidents complain about what’s in the Constitution and threaten to EO. I hated it when Obama constantly did it and am disappointed to see Trump doing it.

Hahahaha... Trump changed the narrative to something HE wanted the media to be talking about and giving congress a firm nudge to get this immigration thing fixed. So much to do; so little time.

Bad deal in my opinion He should carry though with the EO, because that outs the issue front & center. In addition, Congress needs to end visa lottery & chain migration. They both have gotten out of hand.

I hope the President was just thinking out loud, and that he'll still issue the executive order. Nothing's going to change, if he doesn't.

Exactly. Trump is the chief executive tasked with enforcing our laws[Constitution-statutes]

There was no law giving citizenship to children born to illegal aliens. It was made up out of whole cloth by our democrat controlled corrupt stasi state.

The Code of Federal Regulations is where the President can have an effect. For passports, it CFR Title 22, Sec. 51.42 that says

Persons born in the United States applying for a passport for the first time.

(a) Primary evidence of birth in the United States. A person born in the United States generally must submit a birth certificate. The birth certificate must show the full name of the applicant, the applicant's place and date of birth, the full name of the parent(s), and must be signed by the official custodian of birth records, bear the seal of the issuing office, and show a filing date within one year of the date of birth.

(b) Secondary evidence of birth in the United States. If the applicant cannot submit a birth certificate that meets the requirement of paragraph (a) of this section, he or she must submit secondary evidence sufficient to establish to the satisfaction of the Department that he or she was born in the United States. Secondary evidence includes but is not limited to hospital birth certificates, baptismal certificates, medical and school records, certificates of circumcision, other documentary evidence created shortly after birth but generally not more than 5 years after birth, and/or affidavits of persons having personal knowledge of the facts of the birth.

Note that nothing is there about the parents. It could simply be amended via the EO to mandate information about the parent's citizenship status.

Title 22 does talk about this, but mainly to verify that someone has the right to get a passport for a minor.

All he has to do is order his staff to obey it.

That might be true in Fantasy Land, but certainly not in the United States. Trump has known all along that he has to convince the Congress to change the law. He is at least three moves ahead of you. This will need to be done in the Lame Duck session and he needs to bring a baseball bat to the discussions with the Congress in order to get it done. There is nothing wrong with the 14th Amendment. The problem is that the State Department and then the Congress codified a procedure that is in contravention of the 14th Amendment. Amend U.S. Code 8, Section 1401 and the problem goes away. If the Congress refuses, then Trump cobbles the Executive with an Executive Order and fights it out in Court. That will take longer.
