Sen. Jeff Merkley demands immediate court ruling to halt Kavanaugh vote

Sen. Jeff Merkley asked a court Thursday afternoon to quickly step in and delay the Senate from voting on this weekend on Brett Kavanaugh’s nomination to the Supreme Court.

Mr. Merkley has filed a long-shot lawsuit arguing President Trump has violated the Constitution by withholding documents from Judge Kavanaugh’s past, denying senators the ability to make an informed decision on the nomination. That, he says, violates the Constitution’s demand that the Senate give “advice and consent” on nominations.

The Oregon Democrat asked for a hearing Friday afternoon or Saturday morning, just before the Senate is expected to hold a final vote on the judge’s elevation.

“Once the vote is taken, plaintiff’s ability to comply with the Constitution’s advice and consent process will be permanently extinguished,” the senator’s lawyers wrote to Judge Amy Berman Jackson, an Obama appointee to the federal district court in Washington, D.C.

Judge Jackson on Wednesday scheduled a hearing for next Tuesday, after all sides had a chance to submit briefs.

Doesn’t matter. They get one turd judge to issue the stay and we have to wait for it to go up the chain. And SCOTUS 4 to 4 decisions allow the lower court ruling to stand....

They want the documents which are part of the 100K that the President and lawyers has said it’s executive privledge. They have reviewed 500,000 documents over 87 days.

They want the email that is in the 100K which Sen. Leahy says Kav lied years ago when going through hearings for Judge. It has to do with a confidential email that the Dems had, wrote by Leahy that a republican aid took from the computer and passed it on to Kav and others regarding strategy for interviewing judicial nominee’s.

This why they want the court order.

Forgive us in Oregon...lord knows I didn’t vote for him. They must be grooming him for some position. Remember when he went to the border to try to inspect the facility where they were housing illegal children? In the past we hardly heard from him...but, now every issue... there is Merkley, looking for the camera and lights. What is he up to?

Yep it’s their Hail Mary pass- knowing the radical Judges so far ruling against Trump, I expect this to be go through.

If it is granted, the Senate could tell them they have no authority and proceed. I wonder why can’t they get another Judge to over that one. Seems one Judge makes the rule for the entire country.

Of course, Trump could fire the Judge couldn’t he?

I think he fancies himself Presidential material. Can’t be the Veepstakes thing, unless he thinks that guaranteeing Oregon’s 7 electoral votes for the Democrats is some kind of big deal. Pretty much a given.

I’d love to see him in a debate.

Sadly, he was born a couple of hours drive from me , in Myrtle Creek, OR, and then moved to Roseburg for the first grade. Good conservative area. Then, the family moved to Portland.
