You are correct, “going private” was Elon’s way to short squeeze his financial detractors.
I’m not really sure stating a desire to go private after taking to potential financiers should be considered criminal.
If the stock price he mentioned was close to the last quote he saw or discussed with financiers, then mentioning it shouldn’t be considered wrongdoing.
Companies should always be valued on their fundamentals.
