The incident was not a police shooting.
The woman who happened to be a police officer mistakenly believed there was an intruder within her home. The suspected intruder bewildered by her commands did not respond and she shot him.
No, criminality requires intent. She made a mistake. Murder will be hard to prove.
I'd rather wait and see what an investigation and/or trial reveals before assuming the police officer is guilty.

In this incident at least the cop could claim it was a tragic accident or mistake.

French should have done some more research on this. I have read that the officer and victim may have had some sort of relationship. Also on the night this happened it is said that other neighbors heard said officer shouting let me in, if true, contradicts her statement of how she got in.
Too much of her story stinks, hopefully the truth will come out.

I agree with the general idea of this piece, though. A cop is not above the law.

Further a woman shot a man, hence no female group outrage or negative press spin on her, men are disposable and women are victims who just have unfortunate accidents.

First Degree Murder requires premeditation.
Murder in the Second Degree accurately describes her actions as there was no premeditation. 40 years in prison will be an appropriate punishment.
She deserves to be found guilty of some form of negligent homicide. I don’t think she went there with the intent to harm this individual in his home.

Some of the comments in this article are downright silly.
You don’t fire off warning shots. You shoot to kill, if you are in fear of imminent attack on your person or the person of another. The fact she didn’t fire a warning shot, doesn’t prove she was wrong. It proves the writer is wrong.
What proves her wrong is attempting to enter a home that was not her own, mis-perceiving the homeowner as a burglar, and then barking orders he naturally wouldn’t follow, and then shooting him dead. He wouldn’t follow her orders, because to him she was an armed invader. She appeared to be an armed robber.
She deserves to do some serious time in prison.
Warning shots in a home setting like this, could kill an individual in another unit of the building.
There is also the question of whether she was in fact in fear for her life. Did he approach her in a threatening manner? How as he dressed? Was he barefoot and casual? Could this have tipped her off, he wasn’t likely a burglar?
She really screwed up her.
