Dreamers Can Pursue Suit Charging Trump 'Bad Hombres' Bias

President Donald Trump’s administration must defend a lawsuit targeting his plan to end a program offering protection from deportation for hundreds of thousands of children of undocumented immigrants.

U.S District Judge Nicholas Garaufis in Brooklyn, New York, narrowed but didn’t dismiss the suit on Thursday, finding that there was a “plausible inference” that it was illegally aimed at Mexicans. He previously blocked the U.S. government from ending the program known as Deferred Action for Childhood Arrivals, or DACA, and from halting the renewal process, but hadn’t decided whether to allow the case to proceed.

Thank God we have a Republican Majority in Congress to reign in these recalcitrant judges and the inferior courts, which are under their Direct Control. ALL Federal Courts and Judges except the Supreme court are a creation of Congress, Congress is their Daddy!

Trump appealed straight to the Supreme court but SCOTUS refused to hear it.

So now I think the Trump admistration is appealing to circuit courts.

The judge has said Trump can’t end DACA protections for existing DACA applicants. But the judge didn’t extend protections to new applicants.

So at least the damage is ended, no new DACA applicants.

The judge has no right to arrogate the power of the President to himself.

An EO is a temporary direction to the bureaucracy and survives only as long as a President sees fit. It is not a law that lives on once issued.

So where does the Judiciary think they get this kind of power?

The real question in this case is will we let this Constitutional abomination stand. Nothing like it has ever been asserted.

I agree with you the judge is out of line.

The judge said Trump erred in relying on arguments the program was unconstitutional. Don't know if he backed that up with any arguments in his ruling.

Given the judge's claim that the program is constitutional, then the question become can you end a program that provides protections that people were previously counting on? This judge apparently thinks you can ban new entrants but not remove the protections from those already under the program.

I think the judge is out of line. But I'm just trying to make sense of the judges ruling.

Trump appeal should be on two fronts.
