Friday night was a big night for news hawks. And I'm not talking about the upset victory of the UMBC Retrievers over the they-should-have-been-50-points-ahead UVa Cavaliers. Things like that sometimes happen when skill and determination beat odds-makers and reputation.
I'm talking about the firing of Andrew McCabe, who doubtless acted under the impression that rigging things at the FBI for Hillary Clinton was the path to higher office and glory.
Late Friday night, McCabe, the former deputy director and then acting director of the FBI, was fired by Attorney General Jeff Sessions in a statement that reads as follows:
~snip~
"Lacking candor under oath" is the operative phrase. If it were you or I, the charge by a special prosecutor would be perjury. Ask Lewis Libby or General Mike Flynn.
Of note, the President had nothing to do with this; the recommendation came from within the FBI itself based on its analysis of the report it received from the Justice Department's inspector general, an Obama appointee. Bear this in mind when you read McCabe's response and the twist the major media are putting on the firing.
Note also "Under oath on multiple occasions." This suggests but does not prove that McCabe was also interrogated by the outside lawyer the attorney general appointed some time ago to look into the handling of the Clinton email matter by the FBI and Department of Justice officials involved. The inspector general also has the power to administer oaths in the course of his investigation.
McCabe was reportedly given a few days' notice of this intended action and was ready to and did quickly release this statement:

Because then they’re accusing him of, Perjury and the next step would be a Grand Jury and indictments. And, the case would be pretty strong against him and rather easy to prosecute. Document his public statements, compare to what they learned in their investigation and what’s in the OIG report. No much wiggle room, right there. It’s basically, give us a bigger fish, cop a plea or go to trial, found guilty and do some time.
On top of that, any case he ever worked, will now be reviewed by defense attorneys and they’ll be filing to have convictions overturned, etc.
No it doesn’t. A charge of, Perjury, is a completely separate charge, that usually arises from testimony given during a trial, Grand Jury, deposition, or sworn testimony before a Congressional committee, and the person in question is providing that information, Under Oath.
The whole, raise your right hand, swear or affirm that you’ll tell the truth, whole truth and nothing but the truth, so help you God.
This is entirely different than the Feds charging you with 18USC1001, providing false information, etc.
Sessions just let Clapper skate on perjury. Lying only matters if you’re Flynn-had-to-sell-his-house-to-pay-the-legal-bills/associated with Trump.
Royals don't fart they pass wind.
How did federal agents High Crimes and Treason become _firing_offenses_?
DC is a joke, it is a lawless cesspool.
But he's just....alleged...
Perjury is narrow. Candor is broad...."truthful and forthcoming".
[President] Trump blasts fired FBI Deputy Director Andrew McCabe for producing ‘fake memos’ while accusing James Comey of lying under oath

On Twitter Sunday, President Trump tried to suggest that Andrew McCabe ‘never took notes’ when they conversed and so his memos must be ‘fake’
McCabe, who was fired Friday right before he was set to retire, had made memos about his communications with the president, similar to James Comey’s memos
Now McCabe, who had been the FBI’s deputy director, has turned those memos over to Special Counsel Robert Mueller
Meanwhile, President Trump also blasted Comey, suggesting the former FBI director had lied to Sen. Chuck Grassley during a Senate hearing
Comey had said he had never authorized an FBI agent to be an anonymous source for a reporter
McCabe suggested this wasn’t the case, saying Comey knew that McCabe had allowed two FBI officials to talk to a reporter about a Clinton Foundation probe
I don’t know that we are disagreeing. My point was, if you gave “perjury” as a reason for firing someone, wouldn’t her or she have to have been convicted of the charge? I would assume that it would be the same with “providing false information”. It would allow the firee to appeal his firing. By saying someone “lacked candor” you’re saying he was less than honest without crossing any legal tripwires. But I’m not a lawyer, so what do I know?
Groupthink is harmful to truth
my two dollars worth. In state service in california there are 20some “causes for disciplinary action” you give the details in the report. but the “charges” must allege one or more of the causes in the wording of the cause. For instance “Bringing discredit to state service” (as if)
I agree with the posters who say perjury is a legal term and if you say we dismissed for perjury that means a court conviction. You can say, making false statements or knowingly providing false information which are not the legal terms.

We do agree. But they sugarcoated what he did, when they said that “he was not forthcoming” and “lacked candor”. He lied and they know it.
If they had said that he had committed perjury, which he did, then they would have to make a case on him and take it to a Grand Jury, where the DOJ would have to present it. In this case, it would appear that what he did/said could be fairly evident. So, there wouldn’t be much confusion as to what the definition of, IS, is, like one of our former Presidents was able to do.
The difference between, providing false information and perjury:
False Info: you’re questioned by the Feds or police and they later find out you lied about something.
Perjury: You’re under oath, in some type of proceeding and you lie during your testimony.
Giglio Rule: pertains to federal agents that have been found to, lack candor-not be forthcoming-lied to supervisors. Usually happens when an agent gets in trouble, gives a supervisor a story that is later found to not be the truth. Agent is disciplined. However, agent cannot work anymore criminal cases and are left to administrative tasks and training. Because they are now considered unreliable witnesses, but what they did, doesn’t rise to the level of getting them fired. So, there are quite a few federal agents, making 6-figure salaries, that do nothing but surf the internet, play Spider Solitaire, and peruse Instagram all day, on our dime.
Why are they allowed to do that? So they can keep their jobs and COLLECT THEIR PENSIONS.
THEY ARE STAGING A COUP DE TAT AGAINST THE PRESIDENT.
ARREST THEM ALL
FIRE THEIR SUPPORTERS
Agree. Like everyone else, I hope he lets loose a broadside this week. The DOJ IG report and a few indictments would do the trick.

The best thing going for the President on this one is that the IG was an Obama appointee, and this was his report.
Exactly. The head of the OPR is also an Obama appointee, who recommended firing McCabe.
The press - the propaganda arm of the democrat party - must be freaking out. They’ve lost so much credibility in the last few years - and the new stuff will finish off what’s left.
So they gave him two days to destroy evidence and steal property, nice going.
