A 14-year-old girl owes $20,000 in damages after a house party — and her parents are on the hook

After using her parents’ credit card to rent a house in which to throw a wild party, a Canadian 14-year-old is in major trouble — $20,000 worth, actually. That’s the amount of damage the teens caused, and which her parents must now pay.

Last week, police responded to a call that reported an “uncontrolled party” at a neighborhood home in West Vancouver, where nearly 200 teens were seen “flooding out” once officials arrived, according to CTV News. Left in their wake was a house with much destruction — to walls, furniture, and artwork, all of which her parents will be held accountable for.

According to the police report, the young girl responsible for the event had used her parents’ credit card without their permission. But the parents will still have to find a way to pay.

Charge her as an adult and for felony identity fraud. Have that record for life. Won’t teach her, but will teach other teens to follow the law.

Well she did use her parents credit card. I honestly think the property renter should hold some responsible for accepting the credit card from her, and engaging in a contract with her. I'm making some assumptions here because the article does not state if the parents had any involvement in the party at all, or if they did to what extent their involvement was.

But now it becomes the responsibility of the parents to hold their child responsible, to them.

So many parents effectively alternate between ignoring and beating. That’s a dead giveaway of a self centered life. When you became a parent, unless you were forcibly raped into it, you undertook a mission.

The child often prefers the beating to being ignored.

You sound like a Democrat. The kid stole money, probably rented the house on her parents account via AirBnb, and you think she should be let off the hook. The owners did nothing wrong; they were defrauded.

She’s a brat, and her parents should be held accountable.

So what if the kid used her parents AirBnB account? The “idiot” thought he was renting it to her parents, as their credit card was used to pay for it.

Then the parents would potentially be on the hook because they were negligent in giving the girl their account login info. This is different than strict vicarious parental liability.

A rental of real estate is not actually “real property” in and of itself, therefore it doesn’t have the level of contractual law of buying real estate.

Kid’s enter into contracts all the time—by buying things (and this is enforceable, through the parents)—and if this kid bought the rent of the house by fraudulently using her parent’s credit card—than yes, the parents—being responsible for their child’s actions—are responsible to pay—both for the rental fee, and damages (specified in the contract).

The situation is more like a kid buying tickets to a concert—by using their parents credit card without permission than it is to someone buying real-estate (which no minor can do). Assuming they attend the concert—or never get a refund for the ticket—the parents are still liable for the bill.

Just because a child uses fraud in using her parents’ credit-card—does not relieve their responsibility over whatever she bought. Now if a stranger had stolen the credit card—that would be a different issue—as credit card companies don’t hold you liable for that.

I'd sooner rent a house to a truckload of wild chimpanzees on crystal meth. Less risk.

Why is not the LANDLORD also responsible. The renter failed to properly vet the renter.

If I rented my house, then I would be responsible for taking steps do a background check and meet the renter in person and assess risk

Besides that, this is Canadian law, which I’m sure is at least (slightly) different than laws in the US on these things.

Again, even thought the rental was not legal....the parents are responsible for the damages their daughter-and-friends did....and, to pay for the fraudulently obtained rental fee (as rental itself is a form of personal property).

Had the child somehow signed a contract to purchase real estate—that’s entirely different—and would be null and void.

Interesting legal case, actually.

This is the situation we had with a 15 yo girl who lived with us, around $10,000 on the cc tab. Charged as identity theft. Only notably bad thing she ever did but boy what a doozy.
