The Supreme Court on Monday delivered a blow to the Trump administration by refusing to hear the government's challenge to a lower court ruling that has temporarily blocked the administration from winding down the Obama-era Deferred Action for Childhood Arrivals (DACA) program.
The Department of Justices request was rare in that it asked the Supreme Court to jump ahead of the 9th Circuit Court of Appeals in reviewing the case.
The court typically will only bypass an appellate court when theres an emergency involving foreign affairs, a serious separation of powers concerns or when it has already agreed to hear another case dealing with the same question.

Then Trump needs to tell the courts to go to Hell.
No judge of any rank has the authority to issue or maintain an Executive Order and Trump correctly stated that the EO was illegal because Congress is in charge of immigration, not the President or the courts.

We are now in a state of such advanced social and constitutional decay that a prior president’s EXECUTIVE ORDER cannot even be reversed by a new president?
Laughable banana republic. Clown world.
To: Cboldt
I hope that you’re correct - because we pretty much know that the 9th Circus will rule to sustain the lower court’s ruling, and it’d be “nice” (meaning “damned important”) to see what the Supremes think in this day and age of an Executive Order having the force of a duly-passed law.

Precisely!
An EO is only an instruction to executive employees.

Fine. Ignore the lower court ruling and cancel DACA as planned.

I would be surprised if any of the nine voted to hear this case before the 9th Circuit has heard it. Certiorari before judgment is very rare, and I am not sure why it would be warranted in this case. It’s not like the government was in a rush to deport the DACA people even before there was a DACA.

Didnt he just fire one for wanting to use Sharia Law?
No. I've seen that story, and as much as I hate the overuse of the term "fake news," that really was "fake news." There is no Muslim federal judge--the only Muslim ever nominated, Abid Qureshi, was never confirmed by the Senate. There is also no federal "22nd Circuit Court of Appeals," as was mentioned in that story.
Federal judges cannot be fired by the President. They serve until they die, resign, or are impeached and removed by Congress.
To: GIdget2004
They are deliberately denying the executive branch its powers.

Good. DACA is officially OVER!.
The Courts had their chance, now its time to stick a fork in DACA!
NO More DACA! Period.
Pack up and start Walking.
Adios!
Without being smart alecky, why would it be “dead” on March 5th?
Would an EO basically by Trump end it?

Actually it’s half we the people. The other half wants to commit national suicide, be like the very countries that illegals are trying to get away from.

Unless POTUS pulls an Andy Jackson and addresses the nation live on the eve of the expiration to read the constitution to the nation concerning his authority and dares the court to arrest him for doing his duty.

It has to go through an appeals process through higher courts then go to the supremes. So it won’t end in March.

Everything appears to be stacked against Trump. I imagine hes wondering why he even bother to try to save the country. He has to fight everyone, even his own party. The only thing with him is we the people.
Partner, it will always be "We the People" since we have an infantile Fake News MSM that counters everything that President Trump says.
Our infantile Fake News MSM journalists have yet to realize that President Trump is a non-politician!

I believe Gorsuch is likely to the left of Roberts. Roberts has been pretty reliable aside from turning traitor on Obamacare. Gorsuch, IMO, is going to be Sandra Day O'Connor redux.
