Woman who accused Roy Moore of sexual misconduct sues him for defamation (Leigh Corfman)
Washington Post ^ | 01/04/2018 | Beth Reinhard

Posted on 01/04/2018 2:50:07 PM PST by Drew68

In a lawsuit that echoes a civil case against President Trump, an Alabama woman on Thursday sued failed U.S. Senate candidate Roy Moore and his campaign for defamation, citing harsh personal attacks she faced after coming forward with allegations he touched her sexually when she was 14 years old.

Leigh Corfman is not seeking financial compensation beyond legal costs. She is asking for a declaratory judgment of defamation, a public apology from Moore, and a court-enforced ban on him or his campaign publicly attacking her again. She said in a statement that the suit seeks “to do what I could not do as a 14-year-old — hold Mr. Moore and those who enable him accountable.”

A representative of Moore’s campaign, Brett Doster, said he had no immediate comment on the lawsuit, filed in state court in Montgomery County, Ala.

Corfman told The Washington Post in November that when Moore was a 32-year-old assistant district attorney in 1979, he took her to his house, undressed her, touched her over her underpants and bra and guided her hand to touch his genitals over his underwear.

Moore has called Corfman’s allegations of abuse “politically motivated,” “completely false” and “malicious.” On Nov. 10, the day after the story published, he told Sean Hannity of Fox News he had never met Corfman but he did not rule out that he might have dated older teenagers when he was in his 30s.

Discovery will be a bitch for her.

Exactly. It will be demonstrated that she was the local drug whore in the 1970s, and it will go down from there.

So this woman makes an unproven smear during a political campaign to damage him and she’s suing HIM for defamation for defending himself?!

It’s a he said/she said situation, but if I understand correctly the rules are different for her than for him.

If she claims defamation she has to prove that he showed “negligence toward the truth” - meaning, perhaps, that she can claim that he didn’t have her psychoanalyzed by a doctor before saying that her claims were politically motivated rather than just wanting money, having a psychological illness, etc.

If he claims defamation from her he has to prove that she knew she was saying untrue things or showed a “reckless disregard for the truth”.

What a double standard.

But Moore should sue to have Allred disbarred before anything comes of this or any other suit from the lying hag. She presented a known forgery as if it was genuine. She needs to go away for a very long time.

And if the GOPee has even half a brain (I know that’s a huge IF) they should be fighting on Moore’s behalf, because everybody is a sitting duck as long as Gloria Allred can get away with not only lying about politicians, but also gagging them from being able to defend themselves lest they then be sued for defamation where the “public figure” has to prove the unprovable but the liar has only to prove that the politician didn’t turn over every possible leaf to rule out any possibility that the dame is just crazy rather than deliberately lying.

We’re still waiting for Roy Moore to file his lawsuits against his accusers and against the Washington Post, aren’t we?

I've pondered this, and i'm pretty sure the Washington Post's defense is going to be that they just "report" the news, they didn't accuse him of anything. Therefore he has no legal cause of action against them.

For the women, (only two of them) they haven't got a pot to piss in, and there is nothing he can really threaten them with to get them to retract their claims. Also, I would expect any potential jury to be sympathetic to the women who will boo hoo and demand pity on the stand, while hysterically shrieking that he did horrible horrible things to them.

Moore's attorneys would have to attack their character and their life history, because I doubt there is much proof to be had one way or the other. The Three witnesses that put their names to statements saying Moore never went to the Hickory House will help Moore's case, but Jury's can be weird, and I have little doubt that the women will insist on having a Jury trial.

This case would probably be dismissed pretty quickly. Defamation cases are hard to pursue, mainly because the plaintiff can rarely ever demonstrate that he/she has actually suffered any harm that can be measured in a court of law. Ask Sarah Palin about that.

The fact that the "relief" she's seeking includes an apology from Moore pretty much exposes this thing as a PR stunt.

Do you remember some of the people you met 40 years ago when you were 14?
Probably not.
Neither does Leigh Corfman.

WP will never need to mount a defense because Moore will never file suit against them or any of his accusers.

And for good reason.

And if the GOPee has even half a brain (I know that’s a huge IF) they should be fighting on Moore’s behalf,

1) Half a brain? They lack even that much.

2) GOPe swampmonsters like Mitch McConnell and Richard Shelby already stabbed Roy Moore in the back. Repeatedly. And that great hero of swamp-draining, Donald J Trump did exactly nothing about it.

Disagree. Had he become senator, I am confident his conservative scorecard voting record would have been near to perfect approaching that of Mike Lee and Rand Paul. He would have represented the American majority well. It's a shame he was successfully victimized by combined efforts of the uniparty. I hope he demolishes his accuser in court and runs again.

The suit is a joke. She says he said mean things about her because of her “false” accusations.

The article carefully avoids any mention of Corfman’s lawyers.

The firm is owned by the Treasurer of the Alabama Democrat Party. The attorneys represented Corfman long before the Washington Post article. The attorneys wrote Corfman’s story and created the attack on Moore. They previously sent a letter to Moore threatening a lawsuit.
