The feds know everything about this guy since the SOB has entered illegally half a dozen times. It shouldn’t take them too long to grab this roach. It’ll get interesting if it’s found people working for CA government conspire to give aid to this guy in an effort to avoid capture.

I think the Supreme court got it wrong. Hair splitting between courts, nullified the protection against double jeopardy.

Government ran courts are government ran courts. Look at it this way, aren’t all courts supposed to follow the Constitution?

Say that they can’t get you in a District Court, does that mean they can try again, in the Circuit Court? All courts can deprive you of your liberty, the distinction between them is splitting hairs. I simply feel we should defend the basic rights we have reserved under the Constitution.

From one of the comments over on Vox Day's blog:

#1: Deported multiple times before, still came back. = Felon several times over.

#2: In possession of a (stolen) firearm while a felon. There's at least one more felony, possibly two.

#3: Discharge in a public space. Negligent discharge at the very least.

#4: Death occurred due to him while he was committing at least one felony that DOES qualify to raise the death to murder one.

The first three, were never charged by the State. If there are applicable Federal statutes, there's no double jeopardy.

Not to mention, his first story was that he was shooting at Sea Lions.

That's a hunting charge or some vague Crimes Against Gaia they can nail him on.

You have to think of this as a jurisdiction issue. The Federal government is a distinct and separate sovereign from the States. (Federalism 101). Federal Crimes are absolutely distinct and separate from State crimes, no matter how many elements of an offense might overlap.

It’s an entirely different set of laws at play.

This is textbook Duel-sovereignty.

Mexico doesn’t want him...especially in their prison system.

They keep letting him return to sponge of the American tax payers and commit the felons and murders Americans won’t do.

If Mexico honestly gave a flip, they would’ve locked him up, over there, and thrown away the llave.

You want to make him pay for the murder right? So did I. I am disgusted that they could not prove the charges. If the Federal government wanted to prosecute him on immigration charges, they should have done it the first time. Now it’s really all about the murder.

If the city refuses to hand him over, send in troops and grab him.
