EPA moves to kill Waters of the U.S. rule

The Trump administration on Tuesday began the process of formally rescinding the highly controversial “Waters of the U.S.” rule, an Obama-era regulation that gave Washington broad powers over streams and other small bodies of water across the country.

The rule, put forth in 2015 but subsequently stayed by the Supreme Court before going into effect, was one of EPA Administrator Scott Pruitt’s top targets when he took the helm at the agency. President Trump earlier this year signed an executive order directing Mr. Pruitt to review the rule, and with Tuesday’s action, the EPA says it’s finalized that review and will move to permanently strike the regulation from the books.

This is a very nice piece of winning! Now when the rain collects in a little puddle on your property, you will no longer be in danger of your property being declared a protected waterway to be controlled and managed by the federal government.

Is this the same stupid regulation they used to hit that rancher in Wyoming who built a duck pond on his property?

I'm not sure if it was this rule or the Clean Waters Act.

How do regulations ever *get* on the books?

When allowed outside of the legislative process and law, regulations seem free to come and go, last for years, then be removed, only to return again in one form or another.

What is a permanent answer?

I’m okay with them revoking the U.N. River Navigator program started under Clinton as well. Federal control of these waterways always seems intrusive to me.

Granted the expansion of the concept under Obama was outrageous.

This is all great winning, but we need something that prevents the next swing in administrations from putting this all back again. There needs to be legislation (law) that puts limits on what the executive can do willy-nilly.

How will I be able to properly care for the puddle that shows up in my back yard when we have rain?

In many areas of the country, the water belongs to the government, not you. But at least now with this rule obliterated, you'll be able to fill in the puddle hole. At least we have a partial win!

Pass a law defining navigable waters as that which is is used for interstate commerce by vessels of 100 tons or greater. NOT in-state waters as that is a state’s responsibility.
