WASHINGTON (AP) The Supreme Court on Monday struck down part of a law that bans offensive trademarks in a ruling that is expected to help the Washington Redskins in their legal fight over the team name.
The justices ruled that the 71-year-old trademark law barring disparaging terms infringes free speech rights.
The ruling is a victory for the Asian-American rock band called the Slants, but the case was closely watched for the impact it would have on the separate dispute involving the Washington football team.
Slants founder Simon Tam tried to trademark the band name in 2011, but the U.S. Patent and Trademark Office denied the request on the ground that it disparages Asians. A federal appeals court in Washington later said the law barring offensive trademarks is unconstitutional.
The Redskins made similar arguments after the trademark office ruled in 2014 that the name offends American Indians and canceled the teams trademark. A federal appeals court in Richmond put the teams case on hold while waiting for the Supreme Court to rule in the Slants case.

Where did the fetish come from that says others can not be offended either by speech or trademarks. Oh forgot that PC was purposely created so that elites, politicians and academics are free to decide what we can say, think, and do. Average people seem to have no say in this topic.

I went out and purchased Redskins memorabilia based on the idea they’d have to change their name.
It would be great if they didn’t have to.
If I thought they were trying to trash Native Americans, I wouldn’t support it.
To me the team name is a compliment to Native Americans. It’s a sign of respect, nobility, a very strong spirit, and is indicative of a group of winners.

I think you’d be much more comfortable at a liberal site. That way you can spend your days demanding apologies and explaining how and why liberals are habitually offended.

Indeed. Why not? The only way to really get rid of a slur is to appropriate it for your own use. For example how homosexuals appropriated the terms “queer” and “faggot”.
And indeed we’ll be better off for it. Prohibition of use of a slur only perpetuates it’s existence and its power. Appropriate the term instead as homosexuals have done with the term “queer.”
