Convicted Rochester judge appears in court, leaves in handcuffs; jailed without bail

Rochester judge Leticia Astacio appeared in court this morning after being summoned to a meeting with her supervisor who had previously said her job was in jeopardy.

A warrant was issued for Astacio's arrest last week after she failed to appear at a hearing for alleged violations of her probation. Astacio is accused of having her daughter breathe into her interlock device which she must use due to her DWI conviction last year.

Astacio was vacationing in Thailand, but returned to the United States and appeared before Judge Craig Doran on Monday morning. Doran had told her failure to do so would be considered "voluntary abandonment" of her position.

According to WHEC-TV, three Rochester Police Officers arrived about 15 minutes after Astacio, and entered Doran's chambers. They left with Astacio in handcuffs.

Astacio returned later in the day to appear before Judge Stephen Aronson, who made her an offer to plead guilty to charges of declaration of delinquency in exchange for 45 days in jail and one year probation.

Astacio declined the offer, and was held without bail in the Monroe County Jail until a court hearing at 1:30 p.m. Thursday, the Rochester Democrat & Chronicle reported.

"You're doing everything to show you don't care what happens to your public trust," Aronson chided Astacio at her hearing Monday, adding that she was "self-sabotaging" any chance she had to return to her job.

Doran told WHEC-TV that leaving the U.S. for an extended period of time could possibly be a violation of her duties as judge. Astacio kept her position and $173,700 salary, but was temporarily stopped from hearing any cases.

Astacio greeted a group of reporters waiting for her at the courthouse with a smile as she was led out in handcuffs. See video from WHEC-TV below.

Didn’t realize “illegal aliens” had 1) Migrated this far north and 2) had been allowed to become judges. Don’t know why she’d end up in Rochester, where in the winter you can’t tell where the ground ends and the sky begins for weeks at a time. Just a dismal place in the winter. A week was all I could stand being there on business. I guess the three or four months of summer on the Finger Lakes is what keeps people there.

Still receiving her $173,700 salary while sitting in jail. And still has a (slim) chance of retaining her job as a judge. Yeah, the system needs a serious tune-up.
