Justice Department officials plan to issue new guidance on protections for transgender students that will effectively reverse Obama-era recommendations and ensure those issues are decided at the state level going forward.
"That's an issue that the Department of Justice the Department of Education are addressing, and I think there will be further guidance coming from [Justice Department] in particular, with respect to not just the executive order but the case that's in front of the Supreme Court," White House press secretary Sean Spicer said Tuesday.
The Supreme Court is slated to hear oral arguments late next month on a case involving a transgender teen from Virginia who sued the local school board for the right to use the men's bathroom on campus despite being born a female. The debate over transgender "bathroom bills" gained increasing attention late last year after the Obama administration sent guidance to public schools saying they should allow transgender students to use whichever bathroom matches their gender identity.
"The president has maintained for a long time that this is a state's right issue and not one for the federal government," Spicer said when asked for Trump's position on the hot-button issue. "So while there will be further guidance coming out this, I think that all you need to do is look at what the president's view has been for a long time."

The Trump administration decided last week not to mount a legal challenge against a nationwide injunction that has blocked schools from letting transgender students use bathrooms that do not correspond with their biological sex.
During the campaign, Trump himself called the controversial North Carolina bathroom bill "very strong" and suggested he would allow transgender individuals to use either restroom while visiting his skyscraper on Fifth Avenue.

Sounds like a carefully contrived narrative: A "transgender teen" (actually born female) who wants to use the men's bathroom.
The leftist lawyers bringing the case think this will be an easier "sell," than if the plaintiff had been a man wanting to use the women's restroom.
The Left has used this tactic for several precedent-breaking cases ... from Scopes to Griswold to Roe to Hardwick ... they pick a sympathetic person for a wannabe plaintiff, tell their soon-to-be plaintiff to violate the law, and arrange for law enforcement to enforce the law (even when the law is rarely or never enforced). Then, they take their conjured-up narrative to court to overturn existing law.
Sometimes the sympathetic narrative is even a lie - e.g. Leftist lawyer Sarah Weddington claimed that Jane Roe, aka Norma McCorvey, had been gang-raped. Years after SCOTUS's decision McCorvey came forward and admitted the tale was a lie made up by her lawyers to advance the case.

Again, the issue here is THE CONSTITUTION which gives the feds NO authority to meddle in these affairs.
The greatest political need in our country to restore our Free Constitutional Republic is
1) Reinstate the Constitution as the Supreme Law of the Land over the feds and
2) Follow up by dismantling the 70% to 80% unconstitutional potion of the federal government.

IF I understand the CRA (Congressional Review Act) properly, Trump ought to submit Obama’s transgender order to Congress for approval, and have them strike it down (by majority votes). I believe that if Congress reviews a regulation or rule manufactured by executive order, or any other executive branch department, and overrules it, that the executive branch is barred evermore from submitting any regulation that is substantially similar. That would assure it is with the states, unless Congress makes law concerning that subject.
Such action would bar a new president from simply reversing the Trump orders.
Of course, I am assuming that Congress would be able to get a majority of both houses to overturn Obama’s ...
