Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.
Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.
You just can’t make this stuff up.

As Newt said, disband the 9th Circus, get rid of the chaff, start again. It’s the cleanest way, otherwise we’ll be fighting them and wasting time for 8 years.

Sounds like a French White Privilege thing.
Of course, we know the term is en banc.
Proofreading is so much faster than the old days now that we can bring up another tab and check spelling. And yet, Auto Correct still seems to rule the day making the hasty writer appear foolish.
Having a panel of 3 make a decision and then having a motion for an en banc decision is not unusual. Normally, though, it is one of the parties to the action being litigated that makes the request.

I’m all for that! These 3 acted in an illegal and unconstitutional fashion. This is subversion. In addition, their action is giving aid and comfort to our enemies. It is treason and sedition.
The 9th circuit has been overturned more than 83% of the time. That would be cause for dismissal in any job elsewhere. They obviously are failures or idiots or both.
Past time for them to go.
LOL DJT hasn’t read the rule book. The man is rewriting from day to day. One thing few have yet to understand making him able to skate circles around them. As we have witnessed, there is reason to his methods. Always a surprise; never dull, the same old same old. Color me pleased, but a bit saddened. As he is rewriting politics as we know it - henceforth other politicians will scarcely be able to do likewise. For the first time in years, I feel a sense of peace as he holds this office. And enjoying that feeling!
