Yes he can. I was surprised when he decided to comply with the lunatic Oregon judge’s ruling. There are rulings from other courts that conflict with the 9th circuit. I just wish he hadn’t acted like he had to follow it, if he decides not to, the libs will act like he is burning the constitution when in fact it’s the courts that are.
The Judiciary has no authority to override the president’s authority. That’s called separation of powers. And they don’t have the authority to decide cases involving non U.S. citizens.
The big problem I see is that the 9th Circus is emboldened by the 4-4 split at SCOTUS. They are used to getting reversed, but feel that will not happen now.
I’ve been arguing this very point. The court can issue its edict, no matter how un-Constitutional in its overreach, and the President can ignore it, as he is acting well within his authority to do so.
No. But he can proceed with the development of the improved vetting process that would have been implemented at the end of the temporary ban. The courts can’t say Jack about that.
If he ignores a court decision, the impeachment proceedings will start next week. And most republicans will side with the democrats. This could be a trap.
The President relies on others to carry out his orders. I’d bet the permanent bureaucracy will follow the Court and ignore Trump’s EOs.
Congress needs to eliminate lower court (below SCOTUS) jurisdiction to hear any cases involving the issuance of travel visas to alients.
Then, Congress needs to pass new legislation giving the President even more power in this area.

He could do it but it so early in his administration that it would distract from getting other things done where he needs Congress like tax cuts and getting rid of ObamaCare. I sure would not want his whole first term mired in the immigration issue.

This ruling is in direct contravention to the Constitutional requirement that, The United States shall protect each of [the states] against Invasion (Article IV, Section 4) which should have trumped the TRO (illegal and potentially dangerous immigration is invasion). I think trump could give notice why these proceedings are an unconstitutional block on constitutional necessary and proper federal action and ignore the ruling and block the immigrants.
The case in the Robart court in Washington wasnt a good faith challenge to the merits of Trumps EO but a move to issue a temporary restraining order (TRO) which was issued in bad faith IMO since no irreparable harm was shown to validate a TRO. Its a TRO//restraining order hearing where theyre arguing the merits of the EO instead of proving the need for a TRO/restraining order and they have failed to do so as I see it. Freaking Leftist courts.
The U.S. Code Title 8, Chapter 12 statue appears to be contradictory because of U.S.C. 1152 (a)(1)(a) (anti-discrimination clause) which is being used in these challenges. Congress needs to clean that up.
Nevertheless, Article IV, Section 4 absolutely trumps the valid or invalid TRO/restraining order.
