We should first note that the Obama administration’s decision not to prosecute Mrs. Clinton would not bind the Trump administration. Until relevant statutes of limitations have expired, she could still be prosecuted by the new administration. It is possible in my opinion for Clinton to be prosecuted for either her improper handling of classified information on “home brew,” or allegations of “pay to play” arrangements between the secretary of state and donors to the Clinton Foundation, which could constitute bribery.

I don’t think you can get a pardon until you’e actually been convicted, or at least indicted, but I could be wrong

Exactly, a determination not to prosecute (whether Hillary or illegal aliens) would not be binding on the Trump Administration. Only by issuing a presidential pardon could Obama protect Hillary from future federal prosecution (although not for prosecution by a state for a violation of state law).

In the case of illegal aliens, Obama can’t pardon them because a president only can pardon someone for past (federal) crimes, and illegal aliens continue to commit federal crimes every day that they stay in the country illegally, so Obama can’t do anything to stop the Trump Administration from deporting illegal aliens (or to prosecute them criminally, for that matter). Perhaps the best way to ensure that once an illegal alien is deported he isn’t allowed back in is if the DOJ obtains convictions against them for federal crimes, or a plea bargain in return for a guilty plea, with the felons being released on probation with the condition that they would be violating the terms of their probation were they to step foot inside the United States again without a visa or similar legal permission. Any “sanctuary city” that failed to turn over to the feds evidence that a person that they stopped was violating his or her federal probation would be in a world of hurt.

Even if pardoned, or statutes of limitations pass expiration, or whatever shields are enacted - there remains the issue of a major national security breach, which MUST be investigated to identify what happened, what damage was caused, and how to prevent such from happening again.

She might “get away with it”, but her reputation can be irreparably harmed by a proper investigation of objective facts, and others involved can deliver justice by their own means.

It doesn’t matter. They can still investigate her whether she’s been pardoned or not. That means calling them in for testimony and depositions were simply not showing up isn’t going to fly with our incoming Justice Department.

Just think of all the opportunities for Hillary to obstruct justice and perjure herself.

If he pardons her she’s done.In fact,they’re both done.If she were to ask for one he’d probably grant it.If she told him she was opposed he probably wouldn’t.However,his *own* self interest could be a factor...assuming that granting,or not granting,a pardon might help,or damage,him in some way.

Obama can pardon Hillary, and it would probably be to Trump’s benefit if Obama did so.

It would relieve Trump of any ability/obligation to prosecute Hillary. That prosecution would be viewed as highly partison regardless of the facts. The same people who supported Hillary, knowing that she got rich in office, would support her regardless of the evidence. It would be a very polarizing move to prosecute her, regardless of her guilt.

Failure to prosecute, would now be Obama’s fault, not Trump’s.

And it would avoid setting a precedent of prosecuting one’s campaign opponents and/or former first lady’s.

A pardon wouldn’t prevent investigations and revealing to the public what Hillary actually did. But it would remove the most controversial and emotional aspect of such investigations, the direct consequences for Hillary.

Obama can’t do it. Obama is incapable of admitting that he makes mistakes and doesn’t know everything there is to know. Pardoning Hillary is an admission that Obama knew she broke the law. Obama said she didn’t break the law so the facts must be that she didn’t break the law. Obama will allow nations to be destroyed before he admits a mistake.

The article seems to forget that Obama himself could be brought up on charges. Since he knew about the email serve, since he sent several emails there, he is just as guilty. So does the President offer and accept his own pardon in the process?
