“The bottom line is that the Obama administration appears to have blatantly violated the Federal Vacancies Reform Act precisely because it didn’t want to comply with the confirmation requirement for Gupta. It has treated her as the head of the Civil Rights Division from the very first day she was hired and officially named as the acting assistant attorney general.

“This defies the Senate, the Constitution ,and federal law. States, towns, businesses, schools, and police officers who have been targeted by Gupta’s Civil Rights Division should realize that they may have a valid defense under the Federal Vacancies Reform Act against any actions taken against them by the division while Gupta has been the acting assistant attorney general.”

Gupta has been very careful to sign court documents—such as the city of Ferguson, Missouri, consent decree—only as the “principal deputy.” But that does not change the fact that she was officially named as the “acting assistant attorney general.” Such tactics don’t get her around the limitations in the Federal Vacancies Reform Act.

Thus, every action Gupta has taken since May 13, 2015, may have been of “no force or effect.”

This opinion piece was written by a senior legal fellow in the Heritage Foundation. I would trust his legal opinion.

It calls into question the validity of all lawsuits initiated by the division that she authorized; any pleadings filed with the federal courts such as the consent decree with Ferguson that she signed in March 2016 or in DOJ’s litigation against voter ID laws in North Carolina and Texas;...

Somebody needs to get this into the hands of Texas Gov. Greg Abbott and AG Ken Paxton.

The State can sue for relief from the judicial verdict that required re-writing our Voter ID law.

I’ve skimmed through the actual Act. Maybe I’m missing something: Where are the actual penalties for violating the law? The most I see is:


If the Comptroller General of the United States makes a determination
that an officer is serving longer than the 210-day period including the applicable
exceptions to such period under section 3346 or section 3349a, the Comptroller General shall report such determination immediately to —
“(1) the Committee on Governmental Affairs of the Senate;
“(2) the Committee on Government Reform and Oversight of the House of
Representatives;
“(3) the Committees on Appropriations of the Senate and House of
Representatives;
“(4) the appropriate committees of jurisdiction of the Senate and House of
Representatives;
“(5) the President; and
“(6) the Office of Personnel Management.


That’s it?

Looky at all the deliciously scandalous and illegal things that have come out on the Obama/Clinton thugocracy during the campaign and continuing today....and tomorrow and the next day...and right up to Inauguration Day.

Then, JUST THINK of what President Trump and the eagles and hawks in his administration will dig up on this federal crime syndicate AFTER he's sworn in.

Many DOJ folks will be self-deporting soon to try to stay out of the sights of the new AG and others....a good number need to be made example of because of the issues when the Justice System goes corrupt. Lynch for sure and wouldn’t it be nice if the net could also snare Holder?
