The White House on Monday defended President Obamas decision to enter into the Paris climate accord without Senate ratification but stopped short of confirming a Chinese report that he will do so this week during his trip to China.
Still, it would surprise no one if Mr. Obama and Chinese President Xi Jinping were to announce the ratification of the sweeping climate change agreement before the Sunday opening of the Group of 20 summit in Hangzhou, Zhejiang.
White House senior adviser Brian Deese said the president has the legal authority to ratify the accord without the two-thirds Senate vote required for treaties. He said the pact negotiated by 195 countries in December is merely an executive agreement.
The president will use his authority that has been used in dozens of executive agreements in the past to join and formally deposit our instrument of acceptance, and therefore put our country as a party to the Paris Agreement, Mr. Deese said at a White House press conference.
He noted that both presidents announced in March that they would seek to formally join the Paris Agreement in 2016.
Thats a process that is quite well-established in our existing legal system and in the context of international agreements and international arrangements, Mr. Deese said. There is a category of them that are treaties that require advice and consent from the Senate, but theres a broad category of executive agreements where the executive can enter into those agreements without that advice and consent.

It’s non-binding because it’s not lawful.
Well, it’s not like there isn’t precedent, courtesy of Senators Corker and Cruz and 97 others.
There is no real “ratification” of any treaty without the Senate.
Come on America. This is out of control.

Wait a sec...you guys are from two entirely different nations. How can you enter into an agreement about something like "sweeping climate change"...unless the NWO has already been formed and worldwide law is being established? Should have seen the writing on the wall when the U.S signed the Arms Trade Treaty sponsored by the United Nations Office of Disarmament Affairs (for thee but not for me) on Christmas Eve 2014...

When we allowed a man into the office of President that was not a natural born citizen, what did we expect?
If we refused to uphold the Constitution, why should the usurper?

A presidential agreement can be unbound by another president. Only a constitutional treaty is binding as the law of the land.

There are executive agreements. However, an executive agreement must be within the realm of Constitutional presidential competency..i.e., as Commander in Chief, as in a status of forces agreement or in foreign policy. This is neither. The next president or any future president can choose to ignore this action by Obama.
We’ve been through this before. He can sign it but it is not a treaty and is not binding in any way. I think Bubba pulled the same thing years ago..and the senate unanimously voted it down.
Their goal is to make it too difficult to undo, especially after 8 years of Hillary and then Kaine after she falls again or whatever.
But we’re not smart enough to know how they’ll do that.
