There are executive agreements. However, an executive agreement must be within the realm of Constitutional presidential competency..i.e., as Commander in Chief, as in a status of forces agreement or in foreign policy. This is neither. The next president or any future president can choose to ignore this action by Obama.

How many executive agreements involve "depositing instruments of acceptance" with Congressional approval?

Does the President have the power to make unilateral cash transfers to foreign entities?
