GOP delegate fight to stop Trump heats up in federal court

Last-ditch attempts by a group of Republican delegates seeking to stop Donald Trump from becoming the GOP presidential nominee are quickly fading -- and now their fight is facing a federal legal challenge.

At issue is whether delegates to the Republican National Convention in Cleveland are bound to vote for the results of state caucuses and primaries. A group that claims the support of hundreds of convention delegates has been pushing to change Republican presidential nomination rules so that delegates can "vote their conscience" -- reviving a long-simmering debate led by GOP purists who believe that only convention delegates -- not the millions of voters who participated in the primary process -- can ultimately pick a presidential nominee.

Carroll "Beau" Correll, one of Virginia's 49 GOP convention delegates, filed suit in federal court in Richmond on June 24 challenging a state law binding him to the results of the March 1 primary. He's a former federal prosecutor and defense attorney who supported the presidential campaign of Sen. Ted Cruz (R-Tex.). His suit argues that the state law binding him to the primary results violates his First Amendment right to vote his "conscience, free from government compulsion."

What part of "You're there to carry out the wish of the little people - in accordance with the vote across the country." don't you understand?

WE all can't be there - you are there in our stead. And, btw, even to b e a delegate - you have to have have the wherewithal to pay the travel, take the time off work, etc. lodging etc. Many of can't do that either. So you might be looked at as a level of the 'elite'.

You are not there to vote YOUR CONSCIENCE - you are there to carry out the will of THE PEOPLE.

This is much like the Brexit vote. It was all fun and games to let those unwashed masses vote on Brexit when the elites thought things would go their way, but it didn’t and now the same elites are throwing a fit and demanding a revote. Or perhaps the Brexit vote doesn’t count. Total dismissal of the peoples’ choice.

Perfect analogy. And I was for Cruz long before I was for Trump. My questions began when Cruz went to meet loony Glen Beck down at the Mexican border to hand out teddy bears and other freebies to the flood of illegals coming into the country. Illegals they want to vote to destroy what's left of America.

Not sure the plaintiffs would have any standing to bring such a lawsuit.

The Republican Party and its various state affiliates are basically a private organization. The main party allows state affiliates to set their own rules for delegates.

In order for a plaintiff to sue, he/she would have to sue the party affiliate in each state regarding their rules for delegates, and the plaintiff(s) would have to have legal standing in each state.

I don’t see any Federal judge wanting to stick his finger in that mess.

We only know that now because Trump has ripped the masks off of the GOPe traitors like Romney. It’s the same with Cruz: months ago, many here (myself included) thought Cruz was an OK guy. And basically the only reason we know Cruz is a snake is because of Trump.

So why vote if the vote doesn’t really count? If they want to know who the voters want without counting the votes, they could take a poll, drop all the pretense and declare the Republican Party a monarchist party.

GOPe legislators have been going against the wishes of their constituents for so long, they believe it is ethical.
