Ted Cruz Calls Alleged Sex Scandal 'Garbage,' But Hesitates To File Lawsuit

Several political figures have already poked their noses into the issue. Most say that if the allegations are indeed untrue, the Republican presidential candidate should have filed a case already.

On Monday, former Governor Mike Huckabee said that if the senator wants to fight these latest accusations about him, he should start by suing the publication. The governor even cited the lawsuit between Gawker and former WWE wrestler Hulk Hogan adding, "I think he’s got a terrific opportunity to file the lawsuit. And, that’s the way to fight some of this stuff."

Bingo. Basically Cruz is going to have to bend over and take this from the NE,,and if he has had affairs, hope they don’t have the goods on him, otherwise it’s game over. Informative article from 1991 in the Times explains why celebrities never sue.

Huckabee can not be that stupid to make legally equivalent the Gawker case and the Enquirers's "there are some rumors out there" story. And he is legal idiot if he reaqlly beleive his statement of "he’s got a terrific opportunity to file the lawsuit".

Why? I think Huckster has a point. What the Hulkster's case shows is that some courts and juries are more sympathetic to the notion that even public figures have a protectable interest in a private life. Twenty years ago, I think the spirit was more that everything was fair game. Whether the verdict stands on appeal - who knows? But the analogy isn't totally off-base.

Huckabee is ignorant. Hogan sued Gawker for invasion of privacy.

Cruz cannot sue NE for libel based on incorrect, harmful allegations that damaged his reputation. He is a public figure. To prevail in a libel case, Cruz would have to prove that NE acted with malice and knew the allegations to be false.

Cruz cannot sue NE for libel based on incorrect, harmful allegations that damaged his reputation. He is a public figure. To prevail in a libel case, Cruz would have to prove that NE acted with malice and knew the allegations to be false.

In addition to the three lawyers from Williams & Connolly who represent The Enquirer in litigation matters, a group of four lawyers from the firm reads nearly every article before publication. Other supermarket tabloids have similar policies.

This must be cleared up NOW, not over time. We cannot have a Republican nominee with this type of behavior, or even innuendo of this type of behavior. That will be a guaranteed Dem win.

He can’t file the lawsuit, it has to be the women who are non-public figures, he can’t file a lawsuit unless he can prove harm which would mean loosing the nomination and proving this was the cause.

I’m not sure this can be cleared up as a young woman who works for ESPN and the LA Times just tweeted that she had a fling with Teddy back in 2012-2013. Unless she is lying this is going to put Ted on the hot seat.

Apparently this sex-scandal was baited on line over 7 months ago. They solicit tips and comments posted to a forum. Ironically, no one won the August contest. But Cruz was selected in December as the busTed one.

Sounds like they do a good job when the chips are down. Ted could sue because it’s not about actually going to court and litigating it, that would be the worst case scenario for him and a difficult climb mainly because of discovery and disclosure. It is wrong to state because they don’t go to trial that therefore the plaintiff shouldn’t sue. Here’s the point:

“As a result, very few lawsuits ever come to trial. Some end with a settlement that includes a printed retraction or an agreement that the newspaper will not write anything about the celebrity for a specified period.”

You don’t hear a lot of these because the plaintiff’s lawyer sends a threatening letter and a number get settled out of court. So for Ted, get his lawyer to send a threatening letter. At least he could claim ‘my lawyers have corresponded with the magazine.” But there is likely more than enough evidence that he won’t even do that.
