Ted Cruz Calls Alleged Sex Scandal 'Garbage,' But Hesitates To File Lawsuit

Several political figures have already poked their noses into the issue. Most say that if the allegations are indeed untrue, the Republican presidential candidate should have filed a case already.

On Monday, former Governor Mike Huckabee said that if the senator wants to fight these latest accusations about him, he should start by suing the publication. The governor even cited the lawsuit between Gawker and former WWE wrestler Hulk Hogan adding, "I think he’s got a terrific opportunity to file the lawsuit. And, that’s the way to fight some of this stuff."

Why sue? As a public figure, the burden of proof is extraordinarily high, the trial wouldn’t happen until well after the fall election, and it would only draw attention to the allegations.

The National Enquirer has broken dozens and dozens of political sex scandals. They follow the same pattern nearly every time. They start with a teaser which is short on facts. If the hapless politician makes a huge deal over it and gets them a lot of free publicity all the better. Then they trickle out more facts over the course of many weeks. I believe they milked the John Edwards scandal for over a year.

If Ted would have just simply said, “It is the National Enquirer” and left it at that, the media would not have even covered it.

Don’t fall for that crap, it’s a logical fallacy to think that previous outcomes are a predictor of future ones. What matters is whether Cruz had extramarital affairs, and whether it can be proven. That will unfold in time and then we’ll see whether the NE is right or wrong. Until the the proof comes forth, it’s just speculation both ways.

Actually it’s worse having it hang over his head. He’d be better suing or coming clean (if it was true) to put it past him. Otherwise it’s a drip, drip, drip. Just like the NBC issue.

There is no lawsuit here, but not because Cruz is guilty. Cruz is a public figure, running for POTUS, and the allegations in question are part of the discussion of that campaign. To prevail, Cruz would have to not only prove that the allegations are false, but that they were made with actual malice - that the paper knew they were false and printed the story anyway to injure Cruz.

Were I Cruz’ lawyer, I’d tell him to forget it.
