Federal Judge Grants ‘Discovery’ in Clinton Email Case Judge cites ‘evidence of government

A second federal judge has granted discovery to a watchdog group seeking records from Hillary Clinton’s State Department, an unusual move that gives new credibility to claims that State officials intentionally evaded public records laws.

U.S. District Court Judge Royce Lamberth issued the ruling on Tuesday in response to a 2014 lawsuit by the conservative watchdog group Judicial Watch, which has been suing the State Department for documents related to the Benghazi attack.

Judge Lamberth cited “evidence of government wrong-doing” while issuing the decision.

“[W]here there is evidence of government wrong-doing and bad faith, as here, limited discovery is appropriate, even though it is exceedingly rare in FOIA cases,” said Lamberth.

“Plaintiff is relying on constantly shifting admissions by the Government and the former government officials,” the judge added. “Whether the State Department’s actions will ultimately be determined by the Court to not be ‘acting in good faith’ remains to be seen at this time, but plaintiff is clearly entitled to discovery and a record before this Court rules on that issue.”

Judicial Watch will be allowed to request testimony and documents during the discovery phase to help the court determine whether there was an intentional effort by federal officials to circumvent the Freedom of Information Act.

I fear yoou are naive. Clinton perfected the answer that says nothing and avoids perjury during her Whitewater testimony.

Over 250 times she said some version of the following phrases:

I don’t remember; I have no specific recollection of that [document,conversation, etc.]

In a more recent confrontation, Attorney General Eric Holder used the same tactic and phrases in testimony to Congress.

And the beauty of this type of testimony is that you avoid taking the 5th which would look bad.

Won’t be his first rodeo with this bunch of crooks. During the 90s, a case in Lamberth’s court about the secrecy of the government taskforce on Hillarycare resulted in the Judge determining that WH operative Ira Magaziner committed perjury.

Judge Lamberth referred the case to the DOJ for action, but the Democrat Deputy Att. Gen refused to prosecute, even after the Judge fined the U.S. government $250,000 as a sanction for failing to do its duty.

Who was the POS Deputy Att. General? Why no other than Eric Holder who was also the bagman that let Clinton donor Mark Rich get away with a pardon for his criminal acts.

This Democrat party is a continuing criminal conspiracy and should be prosecuted under the RICO statutes—but they are too smart, too clever and too well-connected since they run the government and the bureacracy.

Maybe but just maybe the Judge learned something from that himself. Instead of referring perjury charges to the justice department he can just throw the bastards in jail for contempt of court himself.

Let them sit and rot for a year or two.

You might remember tjat Eric Holder was placed in contmpt of Congress and is still walking around a free man.

If he has to depend on federal marshals who work for Dems, he’s out of the loop.

the MSM will cover for them. Did Eric Holder suffer for his use of the tactic. Who knowss about it—or understands what is happening to the Republic after all is said and done.

Same judge wasm involved with the Clinton WH emails from the 1990’s. Issued rulings to provide. Clinton’s moved out in 2001. Approx. 2003, Judge ruled it was moot because too much time had passed. Going to do the same this time.

Clintons have been doing this alternate email systems since 1990’s. All their people have had “other accounts” Nothing will ever happen to them. Judges have all the authority but can’t seem to schedule anything within a few years time. Disgraceful.

THE NYT REPORTED 3/27/15: Clinton’s review (and erasing?) of her emails did not occur when she was secretary of state ......or even shortly after she left office.

Last October, nearly two years after she left office, the State Department sent her a letter requesting all government records, like emails, she may have possessed. In response, she provided the State Department in December with about 30,000 printed emails that she said were government records. She has said that an additional 30,000 emails were personal.

It appears Clinton still has copies of the emails she deemed public records. Attached to Mr. Kendall’s letter was one sent to him by the State Department this week.

A letter from the under secretary of state for management, Patrick F. Kennedy, said that the department understood that she wanted to keep copies of those documents. Mr. Kennedy said that the agency had consulted with the National Archives, and that allowing her “access to the documents is in the public interest as it will promote informed discussion” as she responds to congressional and other inquiries.

ADDENDUM---The State Dept may also be facing charges of misleading a court WRT the court's request for documents...and for tampering w/ evidence.

......an article months ago mentioned the first server Hillary used was the one in their Chappaqua house for Slick/s use when he left the White House......against the advice of Slick/s people. At some point Hillary went to a server managed by an outside company. Pagliano probably had some involvement in the migration if not sole responsibility.

Hillary obviously had to keep her pay-to-play Foundation business off government computers. Fortunately whether it was Pagliano or someone else, the file deletion/wipe was less than professional.

What’s going to happen to Sid Blumenthal? Not a govt employee, Sid was employed by the Cilnton Foundation and had side business interests.....but Sid had clasified info almost verbatim (as confirmed by the NSA). The next few months are going to be beyond interesting. Hillary is dead meat. (hat tip meatloaf)
