Chicago court will reportedly hear case on Ted Cruz presidential eligibility

Birtherism is now officially a legal issue, as the eligibility of Sen. Ted Cruz to run for president will have a hearing Friday in Chicago, according to multiple news outlets.

According to CNN and ABC, a Cook County Circuit Court judge will hear a lawsuit brought by an Illinois voter who says Mr. Cruz is not a natural-born citizen, as the Constitution requires, because he was born in Canada.

Mr. Cruz has never denied being born in Canada, but maintains that the issue is ridiculous because under longstanding U.S. statutory law, he was automatically a U.S. citizen at birth because his mother was a U.S. citizen.

But Lawrence Joyce maintains otherwise and had filed an earlier case with the Illinois Board of Elections, only to have it rejected earlier this month.

Mr. Joyce told WBBM radio that he supports retired neurosurgeon Ben Carson and has not been in consultation with the campaign of real estate mogul Donald Trump, who has repeatedly said Mr. Cruz might not be eligible to take office.

Still, Mr. Joyce told the station, "my case presents the perfect opportunity for Donald Trump himself to step forward and bring the matter to court personally."

Like Mr. Trump though, Mr. Joyce said his concern is that the eligibility issue lie unresolved during Republican primaries, thus letting the Democrats take advantage of it after a potential Cruz nomination, when it'd be too late.

"At that point, all fundraising would dry up. And his support in the polls would drop dramatically. He may be forced at that point to resign the nomination," Mr. Joyce said.

At a CNN town-hall meeting Wednesday night, the issue was brought up by a voter to Mr. Cruz, who calmly said the legal issue has been "clear from the very first days of the republic."

Guess all those hundreds of thousands of military dependents born overseas may have to be deported if a liberal judge does what Trump is paying him for.

This is PRECISELY WHY he is considered naturalized and NOT Natural born!... His citizenship is established by LAW not inheritance.

The odds don’t look good. This news escaped, the sheeple are seeing and hearing it, might change some folks minds, give them some doubt, make them reconsider, vote for the home boy.

You're confusing the issues. Those military dependents born overseas? With two US parents and born at a US military situation might even be natural born. Even if they aren't it wouldn't be their citizenship that would be questioned. They'd be in NO chance of being deported.

Do you Cruzers make up this stuff as you go along?

You have hit the nail on the head. This is the distinction that many people wish to ignore, citizen by nature vs. citizen at birth by law. But for this argument to prevail there must be the acceptance of the notion of natural law, which unfortunately I doubt exists today. Natural law would restrict marriage to a man and a woman. But we see what the court has done with that. In the end, natural law rests on the belief in God who is the giver of that law. As a society, however, we no longer believe that.

If anyone THINKS any court will touch this, with the HINT of a chance of anyone going back to do the SAME thing with Barry (far too many references [’self-indicted’ IIRC] of him being FROM Kenya, let alone the fake fiasco in Hawaii, his college records, etc.), they’ve got to get some checkups from the neck-up.

The court WILL rely upon ‘precedent’ and long-standing statutory Law; regardless of the Constitution. Our Republic having long been lost...

You bring up an interesting point that resonates with me. My brother was born in the Philippines in 1958. Our parents are both natural born U.S. citizens that were there on active duty military duty.

Yet when my brother joined the Navy in 1975 he was notified that he couldn’t get a TS clearance because he was a ‘dual citizen’. He had to go through the court system and file the paperwork to renounce the Philippine citizenship.

Obviously at one point in time Place of Birth as well as parentage had a very real value to the person involved in the resolving of citizenship.

From now on pregnant moms, if overseas have your child on official US soil like an embassy or military base.

US SOIL, the geographical material withing the 50 states, and i believe US territories.

Thats DIRT, could be gravel, middle of a lake, top of Mt. Rushmore.....!

Its a symbolic meaning of loyalty, means way more than most people are willing to accept.

Thats the requirement to be President, who needs less than 100% American?

That’s interesting. Your brother was a dual citizen, and the path to getting top security clearance was very clear. Does that mean that Cruz shouldn’t have even been eligible for top secret clearance until about two years ago?
