Texas Sen. Ted Cruz (R-TX)97% has repeatedly defended his eligibility to be president this week, but wondering whether his Canadian birthplace would prevent him from running for the office has been on his mind since at least childhood, a classmate of his tells CNN.

16th, 17th, and 18th Century jurists described the acquisition of citizenship by the foreign born children of subject-citizen parents as naturalization at birth and the acquisition of citizenship by aliens as naturalization after birth. Present day State Department practice is to describe the acquisition of citizenship after birth as naturalization and the acquisition of citizenship at birth by children born abroad with citizen parents as “ACQUISITION OF U.S. CITIZENSHIP BY BIRTH ABROAD TO U.S. CITIZEN PARENT”, not requiring a certificate of naturalization. What is usually required is a Consular Report of Birth Abroad of a Citizen of the United States of America (CRBA).

I think you are right... Although I don’t know how big the “some” is. It could be substantial.

Please note on the following

The authors cite to the Naturalization Act of 1790 and ignore the fact that the Naturalization Act of 1795, with the lead of then-Rep. James Madison and with the approval of President George Washington, repealed it and specifically changed "shall be considered as natural born citizens" to "shall be considered as citizens of the United States."

James Madison the "father of the Constitution" changed the wording from "natural born citizen" to "citizen". Madison was no dope and the change was to prevent a foreign born from becoming Commander in Chief. But this also serves to illustrate that "citizen at birth" does not mean "natural born citizen".

Ted Cruz should take Trump’s advice and make all his documentation available.

Show us his mother’s birth certificate, his American passport and /or Canadian passport. His father’s citizenship papers for Canada and USA.

I was surprised to find out there was controversy about his mother’s birthplace. I can’t figure out why there would be any problem finding out where his mother was born, but supposedly they can’t find a birth certificate for his mother in Delaware. She has Wilmington Delaware listed as her place of birth on Ted’s birth certificate.

His parents lived and owned a business in Canada for 8 years. Four before Ted was born.

Ted should release all, if he wants to put this to rest and ask for a declaratory judgement, if that is possible in this case.

I’m a bit late to this thread. What I find a bit disturbing is that he was fretting as a child about obstacles to his becoming president. At what point does a kid become power-hungry enough to decide that he should be leader of the free world?

Trump didn't bring it up. He responded to a reporters question about it.


Reminds me of how a dumb question from the media was handled properly, IMHO. If the Dems/Media are going to bring it up then let them, but lets not do it for them.

Grayson made this claim first, which made me skeptical, but then I saw someone else on another forum (well, a blog, Conservative Tree House) actually bother to contact the state of Delaware as well, and reports back the same: no record found. That individual claims he's currently attempting to get this in writing. I also saw John Nolte and Breitbart bring up the need of confirming her birth certificate as well.

I followed your post right up until the last sentence. I can declare that I have a country called Nitzyland that occupies the 10 acres on which I live and anyone who has a username containing a "y" is a granted citizenship. Therefore you WhiskeyX have dual citizenship. Regardless of whether you want it or recognize it, you have it.

Which law states that both of your parents need to be U.S. citizens for you to be a "natural born" citizen? I would think there would be all sorts of unintended consequences that would affect situations where the paternity was unknown or perhaps a rape took place, etc...

Not sure if it's "power hunger," but I was thinking along similar lines. He was already dreaming about being President as a kid.

You bring up an interesting point. This is why his mother’s information is critical. If she renounced her citizenship and pledged allegiance to Canada before he was born - Ted Cruz is not eligible no matter how conservative he is.

If she did not renounce her citizenship but pledged allegiance to Canada as a dual citizen - should he be eligible?

For me - the answer is NO. I wouldn’t want a DEM under those circumstances to be able to run.

I'd suspect the power desired was related to his father's religion. I have nothing to back that up but a gut suspicion.

Cruz supporters here in FR need to brush up on their reading comprehension.

Learn how to read and quit responding like pit bulls controlled by lawyers or PR hired guns. Example, their crazed pit bull responses over the Macy closing of some stores, release this week. Trump did not gloat over the self inflicted wounds by the Macy maggot infected management.

This citizen issue needs to be discussed and aired out before the armies of Clinton lawyers go on the attack re Ted and his dual citizenship. Anyone, who does not realize how the armies of Clinton lawyers will attack Ted on this citizenship issue has a real problem.

Immediately after being elected to the Senate by the good people in Texas Ted Cruz started planing his campaign to the elected POTUS. This is why more then a few senator intensely dislike Ted Cruz. They see his action in the Senate not a principled stands against the "establishment" but as calculated political moves made to advance is personal ambitions.

Having watched my senator closely ever since he sided with the Muslim Brotherhood over the Egyptian military I've concluded that Ted is a cunning profession politician that thinks shows remarkable flexibility on issues when the political headwinds are blowing against him. I really do not know where is stands on issues important to me.

I recommend the article by Clement and Katyal for a detailed exposition in favor of Cruz's eligibility.

Although there are various treaties and agreements as to citizenship, unlike those in regard to the conduct of war, the principles as to dual and multiple citizenship are not so settled as to be considered generally binding. That is what I meant as to the absence of an international convention on the subject.
