Coulter: Cruz is not a natural born citizen
The Hill ^

Posted on 01/06/2016 9:51:31 AM PST by springwater13

Conservative commentator Ann Coulter, who has been boosting Donald Trump for president, took to Twitter on Wednesday to declare that Sen. Ted Cruz (R-Texas) is not a natural born citizen.

Ann Coulter @AnnCoulter

Same lawyers who said anchor babies are in the Constitution now tell us being born outside U.S to 1 American parent = natural born citizen.

Ann Coulter @AnnCoulter

NYT: Cruz was born outside the U.S. to 1 American parent: "Under the Constitution this makes him a 'natural born citizen.'” Absolutely false

Coulter joins Trump in questioning whether Cruz can legally be president.

“Republicans are going to have to ask themselves the question: ‘Do we want a candidate who could be tied up in court for two years?’ That’d be a big problem,” Trump told The Washington Post on Tuesday.

What I think isn’t the point. Neither is what you think or what the CATO Institute thinks..or Levin or Coulter.

What matters are the opinions of the Justices of the highest court in the land because that is where this matter would end up.

One of them thinks jus sanguinis is enough and another apparently thinks that jus soli may be required.

That right there should tell you this is not settled law and you cannot know for sure how this would end up..especially if Roberts is being blackmailed.

You're right- no one has "standing" to tie it up in court

No one has standing up until now, never underestimate the level of evil that exists in the political/legal system.

NetFlix has "Making a Murder" running currently and people should watch it. Rush has been touting it all week and Megyn had lawyers from both sides on her show last night.

People have been signing petitions to pardon the guy but Scott Walker just announced he would not intercede in the case and the President has no authority to intercede. Kind of foolish to say the President has no authority since his pardon power is absolute except in his own behalf.

I doubt it would come down to being a court issue beyond a certain point.

More likely, it would be left up to 50 state secretaries-of-state, who prepare their state’s ballot.

NO ONE can know how those Justices would rule when they have already shown they may not agree on the requirement should it ever be brought before them.

Back when people could read plain English, no one ever figured the Court would have to tell us what to think, about the issue. That aside the argument is silly because someone other than us will decide or imply or declare what position we will have.

Me personally I think NBC requires Two Citizen parents and born on US Soil, but my opinion does not matter and neither does any other freepers opinion. You will ultimately accept whatever you are told by your betters, what NBC really means.

How has Cruz changed his position? He’s always been against Amnesty, and he’s always been for securing our borders, enforcing our laws and reforming immigration the right way.

Are have you fallen for the Rubio lies?

Natural born had a totally different context in 1780.

Correct constitutional interpretation uses ORIGINAL understanding of the text to gain original intent and purpose.

If we could gain clear understanding of what "natural born" meant in 1780, then that understanding is what should be used, regardless of today's usage.

However, my research came up quite unclear about the original understanding of natural born. The best I could come up with, during the Obama birther thing, was that natural born may include one born on foreign soil to an American citizen parent.

SCOTUS, as the entire federal government, is under the rule of the Constitution (Art VI, Cl 2 - the “Supremacy Clause”). Like the executive and legislative branches, SCOTUS does not have carte blanche power to rule however they choose like the oligarchy they have become.

It very much matters what people think about constitutional issues. The Constitution does not belong to the feds, it LIMITS the feds to only certain specifically delegated enumerated powers. The Constitution belongs to We the People who wrote it.

The problem in our country today is Americans are not taking ownership of THEIR Constitution which is the only legal bulwark of freedom against federal tyranny. Giving the feds carte blanche, blank-check rule over the meaning of the Constitution is like going on vacation with the fox inside the henhouse and is partly why we are in the mess we are in right now.

The feds HATE the Constitution because it limits their power and the feds have tried very hard, especially the last 115 years to loose itself of its constitutional binds and limitations. They have been successful to the degree the people and the states have allowed it.

It is time for the people through their states to investigate federal acts and decisions and determine with good-faith constitutional rationale whether it is constitutional. If it is not, the states should nullify such unconstitutional federal acts.

Also, the role of SCOTUS has been greatly perverted almost from the beginning (this perversion was allowed at the beginning because it wasn’t much of a “felt” problem in the 1700’s and 1800’s). The Constitution does not give SCOTUS some kind of role in unilaterally making nation law. That can be found NOWHERE in the Constitution.

SCOTUS, the judicial branch, was created to resolve certain CASES AND CONTROVERSIES (Art III, Sec 2 Cl 1). The authority of their decision, like any court case, is limited to the case at hand and as precedent for any other like case with similar facts and questions of law. Even then, a SCOTUS decision is only as valid as the use of the Constitution as the basis of reason for the decision. That is why most recent SCOTUS decisions are invalid as any kind of precedent.

Ann is arguing Ted’s mother was not an American citizen when he was born?

_________________________________

Actually, it’s Ted’s father who was not a U.S. citizen. Both mother and father need to be U.S. citizens at Cruz’s birth for him to be a natural born citizen.

Looking over Wiki, for what it's worth, says only 1 parent.

If Ted is on the Texas Primary ballot I'll vote for him.

If Trump ends up the nominee, I'll vote for him.

.
>> “Naturalized citizen refers to those born of American citizens abroad.” <<

.
No, it does not.

It is for those born in another country of parents that are not American citizens.

Anyone born to a mother that is an adult American citizen is automatically an American citizen, regardless of the location of the birth.

This question was clarified by the founders themselves in a congressional resolution.
