As Benghazi inquiry fades, Clinton still faces legal questions about emails

Hillary Clinton appears to have overcome an investigation of her role in the 2012 deadly attacks in Benghazi, Libya, but she still faces a months-long FBI inquiry into the handling of sensitive information while she was secretary of state.

The FBI's Counterintelligence Division, which opened its review this summer after classified information was found in emails transmitted over Clinton's private email server, is under pressure to act quickly, as Clinton is in the midst of running for the Democratic nomination for president in 2016.

Read the article, it tells you why. Just too big to bring down.

Lower ranking person would be in jail already. That is stated in the article.

What I think about Benghazi is quite different that what “the rest of America” thinks.

The Clinton Crime Family is very skilled at covering up their real crimes with issues that drive us crazy, but that most Americans don’t care about.

Benghazi is a classic example. The real crimes are bribery, tax evasion, and fraud.

Instead, poor Gowdy is chasing his tail over a scandal that means nothing to most people.

Peter Zeidenberg, a former federal prosecutor who handles cases against local, state and federal officials, including Vice President Dick Cheney’s chief of staff, Scooter Libby, for leaking the covert identity of CIA officer Valerie Plame, said Clinton’s actions may have been foolish but not necessarily illegal.

“If the emails were not marked, it would not be possible – at least not in my view – to establish that Ms. Clinton knowingly mishandled classified information,” he said. “How was she to know that this was classified if it was not marked?”

Whether they were marked classified or not, or if she knowingly mishandled classified information is not the standard. 18 USC 793 subsection F, does not require information to be classified in order to amount to a violation. Also intent is not the standard, it is gross negligence. From 793:

through gross negligence permits the same ( any document related to the national defense of the US ) to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed,

Just setting up the email server is a violation of this. The documents don't have to be classified. Just an email between her and a head of state would relate to the national defense ). Also there were emails that contained satellite images. Such an email does not have to be marked classified in order to determine if it contained classified info. Her aids were taking classified docs, then cutting and pasting them into a new document and sending that one out. Whether marked classified or not, hey contained info relating to the national defense.
