Rowan Co. Clerk Kim Davis will stay in custody

Rowan County Clerk Kim Davis, a Democrat, will stay in custody.

It was a circus in Ashland today, as media, and protesters on both sides of the Kim Davis controversy came nose-to-nose outside the courthouse.

Rowan County Clerk Kim Davis appeared before U.S. District Court Judge David Bunning at 11:00 this morning, Bunning had her taken into custody finding her in contempt for refusing to issue marriage licenses to same sex couples. Bunning told Davis that she would remain in jail until she complied with his order.

Davis said “thank you” and was taken from the courtroom by a U.S. Marshal. Davis was not taken out in handcuffs.

Judge Bunning then called Mrs. Davis’ six deputies into the courtroom, they were told they were free to issue licenses to all applicants while Davis was held in contempt, but if they did not comply they too would face fines or jail time.

Five of the six clerks said they would issue the licenses, the only one to hold out was Mrs. Davis’ son Nathan.

Judge Bunning was not done with Davis though, calling her back into court at 3:30 this afternoon, but Davis did not come. Instead she stayed in custody, her attorney appearing before the judge to tell him that she would not allow any employee to issue licenses in her absence.

Judge Bunning says he will keep Davis in jail for at least a week, and said “I hope that everyone will remain civil. This country has always had disagreements, but what makes this country different from other countries is that we respect the rule of law.”

In the words of Justice Anthony Kennedy in the Obergefell (sp?) decision:

“Finally, it must be emphasized that religions, and those who adhere to religious doctrines, may continue to advocate with utmost, sincere conviction that, by divine precepts, same-sex marriage should not be condoned. The First Amendment ensures that religious organizations and persons are given proper protection as they seek to teach the principles that are so fulfilling and so central to their lives and faiths, and to their own deep aspirations to continue the family structure they have long revered. The same is true of those who oppose same-sex marriage for other reasons. In turn, those who believe allowing same-sex marriage is proper or indeed essential, whether as a matter of religious conviction or secular belief, may engage those who disagree with their view in an open and searching debate. The Constitution, however, does not permit the State to bar same-sex couples from marriage on the same terms as accorded to couples of the opposite sex.”

I guess Judge Bunning was not aware of this writing.

Somewhere I once read that the Nazi brown shirts were homos. After Hitler was done with them he had them killed off by the SS. Hitler grew to fear them due to how mean they were. That tells you something knowing how bad the SS was.

Has the judge issued her an armband with a cross on it yet?

I imagine they will give her an orange jumpsuit or something. I believe I might try to cut myself, and make a cross symbol on it with the blood.

Either that or a Star of David, to REALLY get the point across.

The most vivid example yet of selective/arbitrary enforcement of the law, and how America has become nothing more than a lawless banana-republic at this point. Will people finally wake up? The persecutions are just starting. The Rule of Law is dead in this country. The Constitution right behind it.

Agree 100%.

Also, selective enforcement undermines public confidence in authority and institutions and encourages law breaking. I believe this is an intentional part of obama's plan to bring down America.

In fact, there could be a lawsuit later to push it back up to the USSC to get this emphasized... however if the whole brittle thing just breaks and the still believing part of the public rises up in God’s power, that might not be a bad denouement either.

At MOST, Kentucky statute was annulled. Now they have no law authorizing marriage.

They must think they have the authority to annull not just the Statute, but the Kentucky State Constitution itself, the same one the County Clerk swore an oath to uphold.

Only a marriage between one man and one woman shall be valid or recognized as a marriage in Kentucky. A legal status identical or substantially similar to that of marriage for unmarried individuals shall not be valid or recognized.

So much for "respect for the rule of law", and "Consent of the governed"

I have always believed that our founders were intelligent, moral and possessed wisdom unmatched since this country's inception.

Yes. They were top notch minds. Far more clever than those who have subsequently replaced them. When I read documents they have written, I am astonished at the clarity of their thought and the eloquence of their language.

But, I'm beginning to think the Supreme Court may be something that needs to be reexamined since it has so easily become apolitical tool.

A defiant county clerk in Kentucky who has refused to issue marriage licenses to gay couples says she will not accept a compromise that would have let her out of jail.

Attorneys for gay couples had proposed that Rowan County Clerk Kim Davis be let out of custody if she promised not to interfere with her deputies, but the clerk refused.

Good for her. I just wish there were thousands more like her.

Hi HT RN,

Of course, you are right. I just read a post about a judge in your fine state declining to issue divorce decrees until the Supremes decide what marriage is, and if they can be terminated. I admire a judge with spunk. My hear, and prayers, are for Clerk Davis. I pray that Judge Bunning gather wisdom through some miraculous means, and releases Ms. Davis.

My ex, his Pa is a Democrat to it being a religion! However I can talk politics to that man and would you believe that he and I can agree on things and NOT want to kill each other! He can’t stand Obama and what that man had done!

After Obama I just can’t see this state voting Democrat for a long long time. They should have known better than to mess with coal miners.
