Connecticut Sens. Chris Murphy and Richard Blumenthal, both Democrats, have called on President Obama to take executive action to close a loophole in federal gun control legislation.
The so-called default to proceed rule under the Brady Handgun Violence Prevention Act allows firearm dealers to sell a weapon to an individual if they have not been notified by the FBI of a buyers criminal background within three business days.
If the background check has not been completed within three days, the dealer has discretion to sell the firearm.
The rule allowed Dylann Roof, the alleged killer of nine people at a predominantly black church in Charleston, S.C., to purchase a gun even though he was arrested on a felony drug charge and admitted to possessing drugs.
"We shouldn't give known criminals the benefit of the doubt when it comes to guns. If law enforcement needs more than three days to ensure they're not giving weapons to dangerous people, Washington must allow them the time to do their jobs, Blumenthal and Murphy said in a joint statement.
If we refuse to act, we're just biding time until this happens again."
The criminal background check on Roof was not initiated until two days after Roof first attempted to purchase the gun and did not discover his admission of drug possession until five days later.
FBI Director James Comey told reporters Friday that Roof should not have been allowed to purchase the gun he allegedly used that evening, referring to the deadly June 17 attack.
Republicans, however, blame the failure to bar Roof from obtaining a gun on bureaucratic bungling and say additional regulation is not necessary.

Is this really the case? Was there no approval/confirmation number from NICS to the dealer?
Further, is there any real proof that if this is the case it was because of an arrest without conviction?
Insanity is believing 9 people would be alive today if Dylan had just failed a background check.
From what I heard, he admitted to prior drug USE....I do not know if this is true or not.
My main point of contention is that there is one thing you can always count on a Democrat to do - lie.

My first action as President would be to revoke, invalidate and rescind EVERY executive order this Muslim ever signed while pResident. Every frigging one of them.
Our country can’t do a background check on a candidate for the presidency. What makes anyone trust background checks? It is just one more attempt to take yet another step toward civilian disarmament. That is exactly what will happen, and it would completely legal. An administration like Obama’s could simply delay investigations for months or years, and we also know they would probably use the power selectively against political opponents.
We never wanted a king. In fact, we got rid of the king we had as I recall. Of course, we are in the process of rewriting history so that may have changed by now.
At which time, knowing the gun had been released to a person that knowingly lied on the 4473 Form, and was charged with felony drug posession, they immediately sprang into action to find, detain, and prosecute him... crickets...
Isn’t the problem the FBI not doing it’s job?
Well, apparently just an accusation of “domestic abuse/violence” is enough to get someone on the “DO NOT SELL TO” list in a lot of places. No conviction required. How does that friggin’ work? Not an issue at my house because we’ve learned the art of compromise. She tells me what she wants and I compromise by agreeing. Simple. :>}
