The Supreme Court ruled Monday in favor of Samantha Elauf, a Muslim woman who sued for discrimination after not being hired by Abercrombie & Fitch, because her insistence on wearing the Muslim hijab conflicted with their dress code.

The case started in 2008 when Ms. Elauf, then 17, applied for a job in a children’s clothing store owned by Abercrombie & Fitch at Woodland Hills Mall in Tulsa, Okla. She wore a black head scarf but did not say why.
I thought discrimination was legal based on appearance. don’t they hiring young, fit healthy model looking people to sell clothes? hooters does the same thing. if you don’t look a certain way, you don’t get the job.

What the hell is wrong with these guys? I was expecting a 5-4 decision, and was even surprised that they might go that far. 8-1, with Scalia leading? Good grief.
I'm not an A&F fan. In the old days, they used to be a high-class British clothing shop. I got my raincoats there, and I remember my mother-in-law had one of their folding stools for shooting pheasants. Then suddenly they went berserk, and now I cross the street rather than walk past their window.
But they still have a right to set limits to what their clerks wear, unless they agreed to something different to begin with--which they evidently didn't.
