Ken Cuccinelli, former Virginia attorney general, said states along the Southern border not only have the legal right to secure their properties by dispatching the National Guard but they pretty much also have a constitutionally based responsibility.
When [illegals are] coming across your border, Article I, Section 10 of the Constitution [gives border states the right to] deal with this themselves, he said during an interview on The Laura Ingraham Show, Breitbart reported.
Mr. Cuccinelli advised, too, that states could task their law enforcement to the borders, too.
He also said the federal government couldnt really prevent states from securing their borders, adding that the only thing the president could do is federalize the National Guard, but theres nothing the president could do about the Texas Rangers or state police, Breitbart reported.

“This is why we had militias, Mr. Cuccinelli went on. This is why militias actually existed. That is the definition of despotism when our chief executive is committed to doing a complete go-around our Constitution.
I posted on another thread that the governors could do a lot more. The states are responsible for the conditions those children are living in. This crisis shows how inept governors are in a real fast-moving crisis situation.
I think they ought to surround the WH first
Now Ken just settle down. The Obama Administration is trying to get as many people with highly contagious diseases in as possible to incapacitate as many Americans as possible. Plus, not enough violent predators and terrorists have been able to get across the border. Have some compassion.
Once this president calls out the military inside the US borders, there will be no going back.
no reason to do one or the other....
Do BOTH :)
This man would be 'current Virginia governor' if the GOP hadn't siphoned campaign donations away from him. The Virginia GOP has let it be known that they would rather have Terry McAuliffe as governor of Virginia than Ken Cuccinelli. And in November, David Bart will find his access to Virginia Republican Party coffers shut off to him as well.
Someone posted elsewhere that the Governors of the border states could set up an agricultural inspection just over the border and stop and reject these illegals via that method. Don’t know if it’s viable, (I know they have them in CA but it’s Jerry Brown we’re talking about) but I thought it was creative.
Are all you people ready to help the border states pay to protect the border?
It's funny that all of a sudden people from all over the country are suddenly interested in this problem that we have lived with for years!
Now that the illegals are being shared with the rest of the country, people there are interested.
Don't point fingers at the border states...put pressure on you own congressmen to do something about the feds doing what they are responsible for!
The border state governors did NOT invite these people in!!! YOUR president did!
Agree with Ken. We also should purge MS13 from Manassas!
..... Bet the National Guard could build a genuine REAL fence pretty darn quick!!! BTW .... how is that zillion dollar “Virtual Fence” working out for ya America?
“...real fast-moving crisis situation. ...”
In a real, MANUFACTURED, fast-moving crisis situation...
That the States have not simply eliminated the border influx is proof that they too are working for new world order and are obediently in on the creation of the crisis.
They could easily dispatch everything at their disposal and start rounding up the invading criminals and putting them into nasty internment camps, from which they could be deported.
Word would get back and the influx would stop.
Every state legislature and governor is guilty of allowing this to happen.
It has reached the point where we states are no longer asking the federal government for help in repelling invasion.
We’re at a point that would have stymied the Framers: we’re asking the federal government—our creature—to stop fighting us and helping the invaders.
mark
Posse Comitatus Act has already been circumvented during Katrina and now by militarizing local law enforcement.
DHS has granted hundreds of millions across the U.S. to arm local law enforcement, not to mention almost every federal agency now has paramilitary swat teams....even the dept. of education.
Obozo said, “a civilian force, just as well funded...”.
Take a look at the paramilitary in the second link. This is Mongomery county Texas Sheriffs office.

he’s not my president if he’s not yours.
I can’t deploy your states national guard. Your governor has to do that.
I live in a boarder state to. All be it a northern boarder state.
I just love that people all over the country are now getting to enjoy illegal aliens.
Personally, I think the people in Michigan have their own ignored problem with the Dearborn muslims! Now MN is getting in on the action.
All govs can send their guard to the border but the state has to cover the entire cost.
So they all want the prez to call out the guard in which case the feds pay half the cost and the state from which the guardsman comes from pays the other half.
When Bush called out the guard, many governors from other states complained about having to pay.
Any many guardsman complain. The signed up to militarily defend the nation but are not pleased to leave their job/career/family to chase wetbacks around the Arizona desert.
It all goes back to the central question: Can the US control the border using enforcement only and how much does enforcement only cost. Or, does the govt have to implement a realistic set of guest worker programs to satisfy the demand by employers for workers, which, coupled with border enforcement, will reduce or eliminate most illegal entry.
