Senate Republicans, led by South Carolina Sen. Lindsey Graham, are pushing for a federal ban on abortions after the end of the 20th week of pregnancy.
The planned legislation, though, will face many challenges, not only from the Democratic-controlled Senate, but from some Republicans like Sen. Mike Lee, Utah, who has concerns about Congress authority to regulate commerce as the laws basis.

The supreme law of the land absolutely requires the states to provide equal protection for the individual God-given, unalienable right to life.

Absolutely. The fact that so many conservatives think it is ok for the federal government to allow states to permit the killing of innocent persons is very disheartening.
Well, we’re living in an age where people on the street want to support “fourth-trimester abortion” (killing newborn infantsimagine that; these monsters are actually thinking of born babies as “potential persons” rather than actual), so anything is possible.
The Commerce Clause is no longer a limit on federal government after the Supreme Court Obamacare decision. In other words, even though Congress might not have the power to regulate abortion directly, they could always impose a million dollar penalty tax that would have to be paid if you wanted one.
Not disagreeing with you, just pointing out there is no longer any limit to federal government power.
If this bill had 49 votes, and needed his vote to pass, he would change his mind and vote against it.
It’s not unconstitutional for a non-state actor to shoot and kill a paraplegic. It’s a violation of a state statute against homicide.

Bottomline, Lindsey Graham is a liberal. And he’s still showing the voters he supports Abortion. He’s fine with killing babies before 20 weeks, he always has been.
This is the oldest trick in the Republican book. Introduce something that sounds super-conservative like a flag-burning amendment or abortion ban just before election season so the rubes back home will think he’s on their side.

Senator Graham is padding his resume.
He introduces a law he knows will never get through Congress, must less be signed by the president, but it makes him appear to be on the conservative side.

I agree with Lee. Either we believe in Federalism or we don’t. If our position when facing the opposition is that the commerce clause shouldn’t be abused and distorted to oppose things like guns, etc....we need to be consistent and not try to use it because it is an issue that we find favorable.
Leave it to the States. The Feds don’t have to (nor are they supposed to) weigh in on every issue. That’s what Federalism is about.
