I would take this answer as a “yes”, the DOJ is spying on members of Conress and the US Supreme Court. This would also offer an Occam’s Razor explanation for Justice Roberts otherwise unexpected vote to uphold Obozocare. It may also provide some fodder to guess why idiots such as Boehner, Cantor and McConnell maintain complete silence as the many unconstitutional, treasonous, impeachable offenses multiply. Of course, they’d have to be dirty enough to provide blackmail material, but that’s hardly a surprise with any of the lot of them.

Holder assured Kirk that there is no intention to do anything of that nature that is, to spy on Members of Congress or to spy on the Supreme Court. This way when it's inevitably unveiled that exactly this event happened, Holder can claim it wasn't 'intentional'.
