I don’t think it was batted anywhere. ACA is upheld (with the exception of the Medicaid provision). End of story as far as I can tell.

Like I said, I don’t see this as a win for Team obama. Its not really a win for the people either.
Otherwise, Ibama still has to get congress to fund this monstosity. Which means we need to get as many conservatives elected in 2008 as possible to not let that happen.
Otherwise, we live to fight another day.

Lyle:
“The rejection of the Commerce Clause and Nec. and Proper Clause should be understood as a major blow to Congress’s authority to pass social welfare laws. Using the tax code — especially in the current political environment — to promote social welfare is going to be a very chancy proposition.”

"They found a way to kick the can back down someone else’s road."

Roberts is loathe to change legislative decisions. This was known when he was nominated.

Thusly he has sent it back to the House (even to statehouses!) transmogrifed as a tax.

This isn't a bad thing. The House can now starve the beast, and even moreso at the State level; while at the same time, every GOP candidate runs on Obama making this the biggest tax increase in history.

The decision might have been good for Bobo looking backwards, but it's a terrible decision in view of his re-election chances.

“If Romney doesn’t come out with an absolute in your face attack and rally the troops statement, it’s time for a brokered convention.”

This.

But with who as our standard bearer?

If Romney doesn't come out with an absolute in your face attack and rally the troops statement, it's time for a brokered convention...

Agree, in the meantime, here's what Boehner has come out with:

WASHINGTON, DC - House Speaker John Boehner (R-OH) released the following statement after the Supreme Court announced its ruling on the president’s health care law:
“The president’s health care law is hurting our economy by driving up health costs and making it harder for small businesses to hire. Today’s ruling underscores the urgency of repealing this harmful law in its entirety. What Americans want is a common-sense, step-by-step approach to health care reform that will protect Americans’ access to the care they need, from the doctor they choose, at a lower cost. Republicans stand ready to work with a president who will listen to the people and will not repeat the mistakes that gave our country ObamaCare.”

arizona overreached by trying to impliment it’s own immigration policies..

No. The law mirrored the immigration policies duly set by the Congress, and, in the absence of federal fulfillment of its obligations, made sure that the law of the land was enforced.

This does place a huge question mark up over his head doesn’t it. Who knows how bad this guy is going to become? This was a monumental screw up on his part.

The Tea Party has just been thrown into hyperdrive. If Romney wants conservatives on board, the Chief Weasel of the United States Supreme Court has just given him the opportunity.

I know it's a stretch, but this decision could be viewed as the high court giving us the motivation to answer the call of our ancestors. I can think of few other things that would motivate the American people to truly fight back against a government gone wild.

I would think congress could kill the “tax”, with simple majority votes in House and Senate. That won’t be possible til after the election. And we need a President that will sign it as well.

From the 80,000 ft level, we’re moving into a situation in this country where Presidents will swear to uphold the laws, and then after elections do whatever they want to not uphold laws. How can any country survive that kind of a government ...

Unless you’re Muslim. Don’t forget that part. If you’re Muslim you don’t have to buy insurance; you’re exempted by Obama. Presumably that means that you don’t have to pay a tax for not buying the insurance either.

IOW, the net effect of this is that Muslims don’t pay a dime, and the infidels ALL pay a tax.

Just like sharia dictates.

lyle :”Interesting, at least to scholars, that while the mandate and its attached penalty are a tax for purposes of its constitutionality, but not for the Anti-Injunction Act. If it were a tax for AIA purposes, this case would not have been decided re the mandate. “
